Council Minutes of 12/20/2005 <br />• Floyd Browne has completed their work on Phase I of the EPA study. He expects <br />to have results next week and will share them with Council when available. <br />Law Director: 1) He will provide his annual report at the first Council meeting in <br />January. He would like Council to review the 8-page submittal regarding further <br />reorganization of the Law Department and to consider it seriously and look favorably <br />upon it during budget meetings. <br />Councilman Miller, chairperson of the Public Safety, Health & Welfare Committee: 1) <br />The committee met this evening to discuss Ordinance 2005-174, an ordinance for the <br />acceptance by the city of an easement for a traffic signal loop detector located on private <br />property owned by NORCAR. (Carnegie Mgt.) The detector is located on the private <br />property side of the entrance drive to the new Brookpark Road mixed use center, the <br />Target store. The city needs an easement to maintain the loop detector. When a loop <br />detector fails, it sometimes affects the operation of the signal and it is in the best interest <br />of the city to be able to repair the loop detector as soon as possible. There was minimal <br />discussion, and the committee unanimously recommended approval and passage under <br />suspension of the rule. <br />Councilman Gareau, chairperson of the Building, Zoning and Development Committee: <br />1) The committee met on December 13, 2005. Present were committee members Gareau, <br />Orlowski and Barker; President of Council Kennedy and Councilmen Nashar and Miller; <br />Mayor O'Grady, Law Director Dubelko, Planning Director Wenger, Human Resources <br />Director Farver. Agenda items included the following referrals from the Planning <br />Commission: <br />• Vienna Woods subdivision. Ms. Wenger reported that the proposal consists of <br />improvement plans for a new 12-unit single family cul-de-sac. This was <br />previously approved by Council some years ago. However, there was a change to <br />it, and it was brought back. The revised plans propose anabove-ground retention <br />or wet basin. This method of water regulation was not previously an option for <br />the developer when the city originally approved the layout. The retention basin <br />will be located on an adjacent property fronting on Lorain Road, which is split <br />zoned commercial and residential toward the rear (north). The basin will be on <br />the residential portion of the lot. The land is required by deed to be permanent <br />green space. The basin will accept storm water from both the residential lots and <br />any future commercial development, and it has been sized accordingly. Covenants <br />have been submitted to the Law Department for review to ensure future <br />maintenance of the facility is handled by the commercial property owner. The <br />city has required landscaping and/or fencing around this detention area for both <br />aesthetics and safety. A double horizontal rail fence in black aluminum will be <br />used. The basin will be aerated to prevent mosquito breeding conditions. <br />Neighbors to the west, Mr. & Mrs. Sara, expressed concern about drainage. The <br />engineer for the project, Mr. Zwick, represented that the drainage should improve <br />and actually help alleviate some of the soft rear yards that the neighbors are <br />currently experiencing.
