Council Minutes of 12/6/2005 <br />3) Recently settled an agreement with the fire fighters regarding overtime pay for <br />members of the Fire Prevention Bureau. <br />4) There are three new ordinances on the agenda relating to Charter amendments which <br />will again bring to the voters the three amendments that failed at the election of <br />November 8. These are important issues for the city government. Hopefully, with a <br />more informative campaign, the voters will look at them more favorably next May. <br />5) Informed the Mayor that the Law Dept. would accept the space that was being <br />provided to it by the administration on a temporary basis. He encourages the Mayor and <br />Council to provide funds so that sufficient permanent space for the Law Dept. can be <br />provided at City Hall. <br />6) Provided assistance in reviewing and/or revising the following contracts and leases: <br />A & J Cement Company contract for the Clague Road rehabilitation; the Peter Zwick <br />contract for the fire station property surveyor; Western Reserve Agency on Aging <br />contract on the nutrition grant program; Cleveland Hockey Supply contract, the pro shop <br />lease at the Rec Center. <br />7) Regarding the Fair Housing Program, he drew down HUD grant funds on November <br />28 for the city's capacity-building efforts. A progress report was submitted to HUD on <br />December 1 showing what we have done to date in our efforts to capacity-build the <br />program. Assistant Law Director O'Malley will be in Washington next week attending <br />HUD's Fair Housing Training Academy. The training is being paid for by the federal <br />government. <br />8) Fire Station No. 2 project-met with Mayor, Safety Director and Planning Director on <br />December 1 to obtain an update on the project status so that the Law Dept. can continue <br />to provide legal advice and counsel along the way. <br />9) Regarding the issue of compliance with Ordinance 2404-175, the Springvale Facilities <br />Operations Mgr. appeared before Board of Control on December 5 and made a financial <br />presentation. In his judgment, it does not meet the requirements yet of the ordinance <br />which requires more specific information regarding ballroom and Heritage Room rentals. <br />The Mayor has assured that the Springvale Mgr. will assembly that information and will <br />present it. <br />10) Civil litigation update: <br />• Amy L. Knappe v. City of North Olmsted, a new tort claim filed against the city <br />by a woman who fell in the bathroom at Springvale was filed November 30. The <br />answer is due December 28. It has been forwarded to insurance defense counsel. <br />• C & C Realty v. North Olmsted Board of Zoning Appeals. The transcript in this <br />2506 appeal was filed by the city on November 18. The appellant's brief is due <br />January 10, and the city's is due February 1. <br />• Shelley Company v. the City of North Olmsted. We took a leave to plead in our <br />answer, and that case will be filed this Friday. <br />• Plute v. City of North Olmsted, re-filed claim by a former Springvale employee. <br />Pretrial is set for Thursday, December 8. That case is being handled by John <br />Latchney of Tomino & Latchney. <br />• Nancy Kovacic v. City of North Olmsted, the State court action was dismissed by <br />Miss Kovacic. It has been re-filed in federal court as primarily a Section 1983 <br />action. Numerous legal issues are involved with that re-filing. It was filed in <br />federal court on December 1 with the same city defendants except former <br />3 <br />
