But here is another delay, and it is <br />reprehensible. <br />3) Jim Burns, representing the Chamber of Commerce, 25045 Lorain Road, said the <br />Chamber is not for or against the Suburban proposal. Their concern is about when is <br />proper notification from the Board of Zoning Appeals finalized. It is their understanding <br />that, as soon as the BZA issues a ruling and the minutes are provided to Council, that <br />every step has been filled. As this discussion goes forward and whatever procedures are <br />determined not to have been done, the Chamber would like to be part of the discussion on <br />what this is going to be and how it affects the business community. Secondly, the <br />Chamber believes the clock starts as soon as the ruling is made. It was implied that the <br />clock didn't start until Council received notification. This should be clarified. The <br />Chamber would like to know if there is a procedure in place where items that are still <br />pending and within anappeal-type timeframe are being provided to new Council <br />members. <br />Law Director Dubelko reiterated that the ruling becomes final within 30 days of when it <br />is made by BZA. The secretary of the BZA has an obligation within 3 days to notify the <br />Clerk of Council. The Clerk of Council presents it to Council. Council has an <br />opportunity to act within 30 days from the date of the ruling. Providing the minutes does <br />not satisfy the requirement of notification to Council. There maybe some history of other <br />cases in the city from quite some time ago that need to be looked at and that were in <br />litigation. That is the appropriate thing for him to do. He does not want any of the <br />parties to be treated unfairly, so he would rather have two more weeks of delay than have <br />an adverse decision potentially by this Council tonight that would end everybody in court <br />where nobody wants to be. He will provide advice to Council and then they will act <br />responsibly and in accordance with the law at the next meeting. The delays are <br />unfortunate, but what the city should do responsibly is correct procedural errors, make <br />sure it's being fair to both sides and put the City Council in a position where it can do its <br />job and vote its conscience and vote in accordance with the laws. <br />4) Charles Dial, 27959 Gardenia, agreed with Mr. Kolick about justice being delayed. <br />Mr. Dial feels there are deficiencies in how residents are notified of important city issues. <br />He has put together sewergate.com and a sewergate blog to start dealing with some of <br />these issues that seem to be particularly rife at the WWTP. On the city's website, he <br />would like to see pictures of all Council members so that residents who are not familiar <br />with the members can recognize them. He would like to see a copy of the Council <br />agenda on the website, and it does not seem that the posting of legislation is up-to-date. <br />Regarding the idea that Council meetings should be televised, he is opposed to that idea <br />and believes it would be counter-productive. <br />5) Dennis Lambert, 25057 Carey Lane, said the League of Women Voters candidate <br />interviews are now posted on the North Olmsted website. He complimented Councilman <br />Tallon on his idea for the Finance 101 class. He attended it, and appreciated how well <br />done it was done. Mrs. Copfer did an excellent job. Mayor O'Grady noted that the <br />League of Women Voters debate would also very shortly be integrated into the city cable <br />14 <br />
