Council Minutes of 9/6/2005 <br />just east of Clague Road is an abomination. There is no reason that should have been allowed to <br />end up the way it is. Our city is having to put resources into that to help Westlake. He doesn't <br />think Westlake is being that cooperative with their ditches. If you look at their history, they <br />don't want traffic going through their town-sounds like the same thing with water. Some of <br />this is having a great impact. <br />Mayor O'Grady said he had not heard about the flow from Fairview causing difficulty in North <br />Olmsted. He heard they had to bypass in Fairview. He can have our Service Director look into <br />this to see if there was an impact. <br />l ti) Don Pangrac, 23470 Sharon Drive, did not have water, but his neighbor did. Has anybody <br />thought that North Olmsted was a lot of farm land years ago and we have continued to build and <br />build. We put asphalt down and the water has got to go someplace. We've had trees taken out <br />for developments. We continue to cover over land which absorbs water and so the water has to <br />go somewhere. Where does it wind up-in our storm sewers and sanitary sewers. Other cities <br />have put a moratorium on construction, maybe this city should look at that. <br />LEGISLATION <br />Ordinance No. 2005-27 introduced by Council Members Miller, McKay, Nashar, and Kasler was <br />given its third reading. An ordinance providing for the submission to the electors of the City of <br />North Olmsted of an amendment to Sections 1, 2 and 3 of Article N, and Sections 2 and 4 of <br />Article IX, of the Charter of the City of North Olmsted to provide for the President of Council to <br />be a member of Council appointed by a majority of the members of Council, rather than a <br />separately elected office, and declaring an emergency, as twice amended. Councilman Nashar <br />moved for adoption, and the motion was seconded by Councilman Ryan. Roll call: Nashar, yes; <br />Ryan, yes; Miller, yes; Barker, no; Gareau, no; Tallon, no, with comment. This ordinance took a <br />lot of time, study and going over. Prior to his getting onto City Council, he was on the Charter <br />Review Commission. At that time, there were two separate ordinances for the elimination of the <br />President of Council's position, one from the Mayor and one from Mr. Lambert. The <br />commission studied them, but he did not feel they were in order at that time. This ordinance is <br />probably the closest to what he feels is acceptable, but he is trying to be consistent in his moves, <br />his votes and his voice and had to vote no on this as he did on the other two. As to the ordinance <br />itself, he wants to commend his colleagues, Mr. Miller, Mr. Nashar, Mrs. Kasler and Mr. <br />McKay, for thinking outside the box and trying to improve something or make a move to change <br />something they felt would help the city. Roll call continued: Orlowski, yes. The motion failed <br />with four yes votes and three no votes as five votes (two-thirds) is needed for passage of Charter <br />amendments. Ordinance No. 2005-27 is not adopted. <br />Ordinance No. 2005-104 introduced by Mayor O'Grady was given its third reading. An <br />ordinance authorizing the Director of Law to retain outside counsel to assist the City of North <br />Olmsted in matters relating to the proposed transfer of the cable franchise of Adelphia <br />Cleveland, LLC to Time Warner NY Cable LLC, and declaring an emergency. Councilman <br />Gareau moved for adoption, and the motion was seconded by Councilman Tallon. Roll call: <br />Gareau, yes; Tallon, yes; Ryan, yes; Orlowski, yes; Nashar, yes; Miller, yes with comment that <br />he is voting yes only because it's his understanding that the city will be reimbursed for any <br />22 <br />
