Council Minutes of 8/16/2005 <br />® • Ordinance 2005-115, an ordinance providing for the submission to the electors of the <br />City of North Olmsted of amendments to Article III, Section 4(d), Article IV, Sections 3 <br />and 5, and Article V, Sections 2 and 3, of the Charter of the City of North Olmsted to <br />allow for the filling of vacancies by election to the unexpired terms in the various elected <br />city offices when the vacancy occurs no less than 30 days prior to the candidate filing <br />deadline for next regular municipal election and the unexpired term has at least two years <br />remaining, and declaring an emergency. There was significant discussion about this, and <br />the committee unanimously recommended to Council the legislation be passed. <br />2) In advance of first reading this evening, the Law Director prepared the following legislation <br />for consideration by the committee: <br />• Ordinance 2005-118, an ordinance providing for the submission to the electors of the <br />City of North Olmsted of an amendment to Article VII, Section 2 of the Charter of the <br />City of North Olmsted to change the name and composition of the city Flanning <br />Commission; to further change and expand the authority of the Planning Commission, <br />further to change the Master Plan review and approval process and relieve the <br />requirement that under certain conditions, voter approved zoning or rezoning proposals <br />for multi-dwelling use. The committee recommended that Council go into Committee- <br />as-the-Whole to consider this legislation. <br />• Ordinance 2005-119, an ordinance providing for the submission to the electors of the <br />City of North Olmsted of an amendment to Article VIII, Section 6 of the Charter of the <br />City of North Olmsted to provide two additional exceptions to the requirement for <br />competitive bidding in the expenditure of city funds, to-wit: (A) emergency situations, <br />and (B) purchases of goods and services through state offered programs, and declaring <br />an emergency. A third part concerning sole source providers was removed and is not <br />part of the legislation. As it exists, Ordinance 2005-119 was unanimously recommended <br />to Council for passage. <br />• Ordinance 2005-120, an ordinance providing for the submission to the electors of the <br />City of North Olmsted of amendments to Article III, Section 3, and Article V, Sections 2 <br />and 3, of the Charter of the City of North Olmsted to provide the express grounds and <br />due process procedure for City Council to remove a Mayor, Director of Law, or Director <br />of Finance from office, and declaring an emergency. The committee unanimously <br />recommended the legislation to Council for passage. <br />• Ordinance 2005-121, an ordinance providing for the submission to the electors of the <br />City of North Olmsted of amendments to Article III, Section 5 and Article V, Section 1, <br />of the Charter of the City of North Olmsted to clarify the existence and extent of the <br />separate authority of the Mayor and Directors to appoint and remove city officials and <br />employees, and declaring an emergency. The committee unanimously recommended the <br />legislation to Council for passage. <br />3) There was significant discussion by the committee on Ordinance 2005-27. As chairperson of <br />that committee, he would have preferred the input from the Law Director on this legislation this <br />evening had been provided earlier. He personally has strong feelings about this particular <br />legislation, but he feels the committee meeting would have been the place for the discussion. <br />The committee did have a long discussion and did discuss the fact that the Charter Review <br />Commission did not approve it by a vote of 3-2 as there were commission members who were <br />absent. The committee discussed the substance of the legislation. He did not get the feeling, <br />12 <br />
