A preliminary injunctive hearing was held on June 20. Following that <br />hearing, he reviewed the matter with the administration, and he contacted opposing <br />counsel. So as not to have a flipping back and forth of procedures involving <br />something as important as call back in the Fire Department, the city has agreed <br />voluntarily to go back to the old call back procedure until we can get this issue <br />litigated on the merits before Judge Sutula. We will be living by the old call back <br />procedure that was awarded by arbitration, but the court will proceed now to hear the <br />merits of our argument in the motion to vacate which was filed by the city. And that <br />is whether or not the arbitrator award has truly drawn its essence from the collective <br />bargaining agreement. The court has established a schedule for filing stipulations of <br />fact, allowing us to contact the court if necessary for a limited facts hearing and has <br />established our schedules for briefs by the city and the union. That briefing schedule <br />carries out the case to early November. <br />2) On June 9 and 10, he responded to a series of four public records requests by IAFF <br />Local 1267 president Boatman involving a request for all disciplines measured against <br />fire fighters in the last several years, all citizen complaints against fire fighters in the last <br />several years, program materials from the OFE program, the graduation of the Assistant <br />Chief that the Mayor reported he attended, and also a request for records of certain <br />personnel-Fire Chief, Assistant Chief and one of the Captains in the department. These <br />were public records request made by the IAFF Local 1267 president, and they have all <br />been responded to appropriately. <br />3) June 11 to the present, he has been working on the proposed F.I.R.S.T. lease. (First <br />Integrated Regional Senior Transportation consortium) The lease has been prepared, <br />several drafts have been made, circulated within the administration and it's on its way <br />now to the F.I.R.S.T. representative. The lease has already been authorized by City <br />Council, and is for the property on Butternut Ridge Road. <br />4) June 13, he attended the final meeting of the Charter Review Commission's pentennial <br />review of the City Charter. He attended mast of the meetings and feels the Charter <br />Review Commission did an excellent job, including former commission member Ron <br />Tallon who is now serving on Council. Also, farmer school board member Claire Hayes <br />was a member of the commission, current Fair Housing Review Board chairman Nicole <br />Dailey Jones did an excellent job on the commission as well as the chairperson of that <br />commission himself, retired Law Director Michael Gareau. It's a really tough job and <br />they've got a relatively short time frame to review the entire Charter. They took input <br />from current members of the administration on current issues. They took information and <br />input from people outside the city government, and they looked at issues they themselves <br />felt were appropriate. They met their mission on time and they have submitted today <br />recommendations to City Council. He encourages City Council to look at their work <br />very carefully-a lot of thought and effort was put into it. This Council has probably <br />even a shorter timeline to do its job if it wishes to place some of these issues on the <br />ballot. The issues must be submitted to the Board of Elections no earlier than 120 days <br />before the election, and no later than 60 days before the election. <br />6 <br />
