Council Minutes of 5/4/2Q05 <br />complaint that the union had violated ORC 4717.11 (b) (3) by attempting to bypass <br />the city's representative and deal directly with its legislative body. The case has been <br />referred to mediation. In a related ULP, the city's outside counsel Gary Johnson <br />attended apre-trial in the matter of the unfair labor practice chazge that had been filed <br />by the union against the city claiming that the city had committed an unfair labor <br />practice by initiating new management policies without first affering the union an <br />opportunity to bargain the effects of those policies. <br />3) City Prosecutor report: In the month of April, Mike Gordillo handled a total of 208 <br />cases in Rocky River Court, 165 of which were traffic cases. The remaining 35 were <br />General Offenses cases. He took 118 guilty pleas, tried 2 cases and had 2 convictions. <br />Defendants didn't show and capias were issued in 38 cases, 2 cases were bound over to <br />the grand jury and 48 remain pending at month's end. <br />4) On April 21, attended a meeting of the Fair Housing Review Boazd which is making <br />good progress. <br />5) April 22, at the request of the Director of Personnel & Administrative Services, he <br />provided a formal legal opinion, No. 2045-02, to the Civil Service Commission regarding <br />the subject of classifying assistant directors and assistant division heads. <br />6) April 25, researched and provided written legal advice to the Fire Chief regarding a <br />public records request made by the president of IAFF Local 1267. <br />7) The Mayor previously reported on the labor-management meeting with the fire <br />fighters. These efforts are being assisted by a very qualified individual, Tim Viskocil <br />who is an FMCS mediator. <br />8) April 27, provided written legal advice to the Fire Chief on the subject of the city <br />granting compensation to IAFF Local 1267 employees who attend unfair labor practice <br />and other related types of hearings. <br />9) Attended the Citizen of the Year banquet put on by Community Council, and it was a <br />very nice, well-run dinner this year. <br />10) May 2, Cleveland State University executed the work/study agreement Council had <br />previously approved for the grants for the city's law clerks. Both law clerks have since <br />qualified for grants for the next year. <br />11) May 3, provided legal advice to the Service Director regarding the posting of political <br />signs on city property. Those postings violate the city's no posting ordinances, 541.08 <br />and 947.01 (h). The latter ordinance refers to posting on parks and recreational property. <br />Such no posting laws have been uniformly upheld by the United States Supreme Court as <br />constitutional. It's important that the city continue to uniformly enforce these laws in a <br />content-neutral fashion. There is a risk of having local laws invalidated if they are not <br />uniformly enforced and if decisions are based on the content of the sign. <br />12) Attended a meeting with the AFSCME Clerical Technical representatives regarding <br />implementation of a memorandum of understanding that the city entered into last year <br />regarding beginning to include certain part-time employees within that bargaining unit. <br />That meeting has been rescheduled for matters to be further discussed. <br />Finance Director Copfer: 1) On May 1, the Finance Dept. began entering cash receipts on <br />the new system manually. City Hall employees were cooperative by adding the new <br />account numbers on their forms in a very quick fashion. Eventually we will go on to an <br />automated receiving system and also decentralized in some areas. <br />3 <br />
