~. Council Minutes of 4/19/2005 <br />Ordinance No. 2005-62 was introduced and placed on first reading by Councilman <br />Gazeau. An ordinance amending Section 915.04 (User Charges) of the Streets, Utilities <br />and Public Services Code, in order to change the procedure for obtaining a refund in the <br />sewer charge refund program for users of less than one thousand cubic feet (MCF) of <br />water per billing quarter, and further to establish new qualifications for entitlement to <br />participate in the said program; and declaring an emergency. <br />Ordinance No. 2005-63 was introduced and placed on first reading by Councilman <br />Gareau on behalf of himself and Councilman Nashaz. An ordinance creating new Section <br />1334.10 of the Building Code, entitled "Landmarks; Fee, Deposit and Expenses <br />Reimbursement Waiver," in order to authorize the waiver of fee, deposit and expenses <br />reimbursement requirements of Chapter 1334 for non-profit organizations moving North <br />Olmsted landmarks within or out of the City of North Olmsted. Councilman Gareau <br />moved for suspension of the rules requiring three readings and committee review. The <br />motion was seconded by Councilman Nashaz and passed unanimously. Councilman <br />Gareau moved for adoption, and the motion was seconded by Councilman Nashar. Roll <br />call: Gareau, yes; Nashar, yes; Kasler, yes; Limpert, yes, with comment, as important as <br />it is to be looking towards our future, he thinks it's very important the city does some <br />things to help protect our past. He thanks Council and the administration for this. Roll <br />call continued: Miller, yes; Dailey, yes. The motion passed unanimously. Ordinance <br />No. 2005-63 adopted. <br />Resolution No. 2005-64 was introduced and placed on first reading by Councilman <br />Nashar on behalf of Mayor O'Grady and the entire Council. A resolution urging the Ohio <br />Department of Transportation ("ODOT") to reconsider its decision to eliminate from the <br />Fiscal Year 2005 Urban Paving Program the section of relocated State Route 252 ("SR <br />252"), located in the City of North Olmsted, from Country Club Boulevard to Al Moen <br />Drive, that includes the approaches to and the bridge over Interstate 480 ("I-480"), and <br />declaring an emergency. Councilman Nashaz moved for suspension of the rules requiring <br />three readings and committee review. The motion was seconded by Councilman Limpert <br />and passed unanimously. Councilman Nashaz moved for adoption, and the motion was <br />seconded by Councilman Limpert. Roll call: Nashaz, yes; Limpert, yes, with comment: <br />that we didn't design it, we didn't contract for it, we didn't build it, and we didn't break it. <br />We shouldn't have to replace it at our expense. Roll call continued: Miller, yes, with <br />comment that he finds it refreshing that the Mayor and the Service Director are going <br />after this issue, have kept Council informed and have lobbied strong. It's nice to have all <br />of Council supporting the Mayor and the Service Director in those efforts. Thank you. <br />Roll call continued: Kasler, yes; Dailey, yes; Gareau, yes. The motion passed <br />unanimously. Resolution No. 2005-64 adopted. <br />MISCELLANEOUS BUSINESS <br />Councilman Gazeau scheduled a BZD Committee meeting for 6:45 p.m. on Monday, <br />April 25, to discuss a Planning Commission referral. The Planning Director and a <br />Building Dept. representative are asked to attend. <br /> <br />18 <br />
