Ordinance No. 2004-200 <br />amended. <br />Ordinance No. 2005-25 introduced by Councilman Gareau was given its second reading. <br />An ordinance authorizing the Building Commissioner to proceed with the demolition and <br />removal of dangerous buildings located at 4170 Columbia Road, in the City of North <br />Olmsted, as a public nuisance, and further authorizing the costs to be certified as a tax <br />lien upon said premises, pursuant to Section 1331.05(e) of the Codified Ordinances, and <br />declaring an emergency. Councilman Gareau moved for suspension of the rule requiring <br />three readings and noted the legislation had been reviewed by committee. The motion <br />was seconded by Councilman Limpert and passed unanimously. Councilman Gareau <br />moved for adoption. The motion was seconded by Councilman Limpert and passed <br />unanimously. Ordinance No. 2005-25 adopted. <br />Ordinance No. 2005-26 introduced by Councilman Dailey was given its second reading. <br />An ordinance creating new Section 139.13 of Chapter 139 of the Administrative Code <br />entitled "Department of Public Safety" for the purpose of creating a new position of <br />"Assistant Course/Facility Maintenance Supervisor" within the organizational chart of the <br />Division of Springvale, and declaring an emergency. <br />Resolution No. 2005-28 introduced by Councilman Gareau on behalf of Mayor Musial <br />was given its second reading. A resolution authorizing the Director of Law to settle the <br />lawsuit entitled, State, ex rel. Gamey Real Estate Co., et al. v. CitYof North Olmsted, et <br />a1., Cuyahoga County Common Pleas Court case No. CV0452871; further authorizing the <br />Mayor to execute all agreements necessary to effectuate said settlement; and declaring an <br />emergency. Councilman Gareau moved for suspension of the rule requiring three <br />readings and noted the legislation had been reviewed by committee. The motion was <br />seconded by Councilman Nashar and passed unanimously. Councilman Gareau moved <br />for adoption, and the motion was seconded by Councilman Nashar. Roll call: Gareau, <br />yes; Nashar, yes; Miller, yes; McKay, yes; Limpert, yes, commenting he would like to <br />thank the Law Director and outside counsel for getting us out of the potential jeopardy <br />that we were in with this lawsuit. Roll call continued: Dailey, yes. The motion passed <br />unanimously. Resolution No. 2005-28 adopted. <br />Ordinance No. 2005-30 was introduced and placed on first reading by Mayor O'Grady on <br />behalf of himself and the entire Council and noted that Ordinances 2005-30 through <br />2005-34 are renewals. An ordinance providing for the issuance and sale of $3,500,000 of <br />notes, in anticipation of the issuance of bonds, for the purpose of constructing, <br />furnishing, equipping and otherwise improving a fire station, providing fire apparatus and <br />equipment to be housed therein and acquiring, preparing and otherwise improving real <br />estate and interests therein for its site; and declaring an emergency. Councilman Miller <br />moved for suspension of the rules requiring three readings and committee review and <br />noted Council was in receipt of the Fiscal Officer's Certificate. The motion was seconded <br />by Councilman Nashar and passed unanimously. Councilman Miller moved for <br />adoption.
