s <br />Council Minutes 4/5/2005 <br />Councilman Dailey scheduled a Recreation, Public Parks & Buildings Committee <br />meeting immediately following the Public Safety Committee on April 12. The <br />committee will discuss Ordinances 2005-41 and 2005-42 and Resolution 2005-43. Safety <br />Director Jesse and Service Director Driscoll aze asked to attend. <br />Councilman McKay scheduled an Environmental Control Committee immediately <br />following the Recreation Committee on April 12. The committee will discuss Ordinance <br />No. 2005-36. Service Director Driscoll is asked to attend. <br />Councilman Nashar scheduled a Streets & Transportation Committee meeting <br />immediately following the Environmental Control Committee on April 12. The <br />committee will discuss Ordinance 2005-39, Resolution 2005-40 and the 2005 capital <br />improvements. Service Director Driscoll, Finance Director Copfer, Law Director <br />Dubelko and City Engineer Durbin are asked to attend. <br />Councilman Nashar inquired of the Law Director whether the collocation of towers had <br />caused some towers to be abandoned and whether the towers could' be taken down. Law <br />Director Dubelko said he did not know if there were towers to which that would be <br />applicable. The city encourages collocating. Our leases require that, if they don't utilize <br />the pole, it is the responsibility of the tenant to take down the pole and bear the cost of the <br />removal. Councilman Miller said Mr. Jesse had indicated at the Recreation Commission <br />meeting that, if the owners of the poles decided they no longer wanted them, the poles <br />would then revert to the city for the cost of $1. Does the city want to beaz the cost of <br />removal? Law Director Dubelko said he would have to look into this issue. There is a <br />lease from 1997 between the city and AT&T and there are various provisions regarding <br />obligations of the tenant with respect to the pole: maintaining the pole, taking the pole <br />down. If that in fact is the city's obligation to give the tenant a choice of taking it down <br />or turning it over to the city, we'll live by the lease just as we expect the tenant to. Mr. <br />Miller asked that the city continue to get permission to put on an audible alarm system for <br />emergency services should we have monies to do that in the future. <br />Councilman Limpert questioned whether the discussion of all capital improvements <br />would be taken up in the Streets & Transportation Committee as there are other items in <br />addition to street repair. After a short discussion, the issue was assigned to the Streets & <br />Transportation Committee. <br />Councilman Nashaz made a motion to excuse the absence of Councilwoman Kasler. The <br />motion was seconded by Councilman Limpert and passed unanimously. <br />With the agenda being completed and there being no further business to come before <br />Co ' ,President ro eau adjourned the meeting at 10:07 p.m. <br />azbaza L.
