1.. <br />Council Minutes 4/5/2005 <br />convictions. A number of cases remain pending. If any member of Council is interested <br />in the specific statistics, it's available in the Law Dept. Also, he has been working with <br />the new city Prosecutor in fashioning a new victim's rights policy for the City of North <br />Ohnsted's Prosecutor's office. Hopefully that will be in place in the very near future. <br />4) During the last part of March, he spent significant time on the phone and reviewing <br />documents with and from HUD relating to the city's receipt of a $120,000 grant from <br />HUD to implement the city's local fair housing program. Council has before it legislation <br />relating to that grant tonight. <br />S) On March 17, he participated in the sad closing of the RTA/NOMBL transaction. It <br />was successfully closed. Complete copies of the fully executed agreements between the <br />city, RTA and AFSCME Ohio Council 8 Local 3517 are in the Law Dept. Any questions <br />regarding RTA's continuing obligations to the city, particularly with respect to quality <br />and quantity of bus services within the city should be directed to the administration or to <br />the Law Department. <br />6) On March 21, he attended a meeting of the Safe Staffing Committee, which is charged <br />with the responsibility of reviewing the staffing levels in the Fire Dept. and making <br />recommendations ultimately to the city. The meeting was very productive. At this <br />meeting, Assistant Fire Chief Ed Robertson was selected as chairperson. <br />7) Mazch 21, he attended a meeting of the Charter Review Commission. The commission <br />under the leadership of retired Law Director Michael R. Gareau is making great progress <br />in reviewing the city's Charter and preparing to make recommendations to City Council. <br />He has no doubt that the commission will complete the assigned task on time and that <br />Council will have the opportunity to review and act upon a solid set of recommendations <br />for amendments to the Charter by the end of June. Council's window to adopt legislation <br />placing Charter amendments on the ballot this year is between July 11 and September 9, <br />which is the 60 to 120 day window before the date of the General Election. <br />8) On March 22, he issued legal opinion, 2005-01 providing an opinion to the Clerk of <br />Council, as custodian of Ethics Commission records, that the Mayor does not have <br />supervisory authority over either the Clerk of Council or the Ethics Commission, and that <br />absent demonstration of a need to access confidential records of the Ethics Commission <br />in order to perform the duties of his office, and a need that outweighs the need to preserve <br />the confidentiality of such records, the Mayor should not be provided access to <br />confidential records of the Ethics Commission. This inquiry from the Clerk of Council <br />came as a result of a request by former Mayor Musial. <br />9} March 29 and April S, he attended directors' meetings at City Hall. <br />10) March 31, he provided the Board of Elections with a letter containing legal advice <br />previously provided to the Mayor and Council that, under the North Olmsted Charter, <br />write-in candidacies are permitted in accordance with general law. That is state law that <br />permits such write-ins at both primary and general elections. <br />11) From April 1 and on, he has provided written advice and counsel to various members <br />of the city government in response to a bevy of memos and directives issued by Mayor <br />Musial on or near his final day in office.
