Special Council Minutes of 3/22/2{)05 <br />the lawsuit entitled, State, ex rel. Ganl~ Real Estate Co., et al. v. City of North Olmsted, <br />et al., Cuyahoga County Common Pleas Court case No. CV0452~71; further authori2ing <br />the Mayor to execute all agreements necessary to effectuate said settlement; and <br />declaring an emergency. Councilman Limpert noted there had been a request for <br />suspension of the rules from Law Director Dubelko. Councilman Gareau preferred not to <br />suspend. Law Director Dubelko said he thought that some members of Council are <br />concerned that passing it at a special meeting might not give the opportunity to the public <br />to comment on the legislation and have their input, and it might be viewed <br />inappropriately. Even though he requested that it be passed under suspension, which <br />would be pretty typical for settlement of a case that had been discussed previously in <br />executive session, he would have no objection if Council would prefer to act upon it at a <br />regular meeting. Councilman Nashar asked if this had a time frame for settlement, and <br />the Law Director answered no. But once parties reach a settlement, it should be <br />concluded expeditiously. He did not believe two weeks from today would cause any <br />problems. Councilman Miller said he felt by putting it on a special Council agenda, <br />Council was moving expeditiously. Because of the fact that this issue has had numerous <br />meetings and it was a very emotional issue for several people, he concurs with Mr. <br />Gareau's opinion this is not something we should give an appearance of rushing. <br />Councilman Gareau made a motion to excuse the absence of Councilwoman Kasler. The <br />motion was seconded by Councilman Nashar and passed unanimously. <br />President O'Grady assigned Ordinance 2005-27 to the Intra-Governmental Relations <br />Committee, but it will first be reviewed by the Charter Review Commission. Ordinance <br />No. 2005-28 was assigned to the BZD Committee, and it will be added to the committee <br />agenda of March 29. <br />Councilman Limpert thanked President O'Grady for his tenure as President of Council <br />and said he looked forward to his moving across the room. (To the Mayor's chair.) <br />President O'Grady said it had been his pleasure to serve with the members of Council. <br />With the agenda being completed, President O'Grady adjourned the special Council <br />at 7:17 p.m. <br />J <br />L.
