Council Minutes of 1/18/2405 <br />® 4) Michael Gordillo is the new City Prosecutor. He is a fine young attorney who has <br />acquired a lot of valuable prosecutor experience in the last four years serving as a <br />supervising attorney in the County Prosecutor's office. He will do an excellent job for the <br />City of North Olmsted and for the cause of justice in the City of North Olmsted. <br />5) January 10, he prepared and made a contract process presentation to city employees. <br />The session was held at Springvale and was well attended. <br />6) Januaryl0, he received afully-executed copy of the city's interim referral agreement <br />with HUD for review of fair housing complaints filed in the city. This agreement was <br />authorized by Council legislation last summer, but it took a little while far it to wind its <br />way through federal channels to get signatures. He expects to be contacted shortly by <br />HUD regarding implementation of this joint project with issues like staffing and training. <br />He will keep the Fair Housing Review Board and the Council representative up-to-date. <br />7) January 13, the Law Dept. collected $7,500 from an insurance company in the North <br />Olmsted vs. Sandra Wheeler case, which involved damage to a police cruiser. There is <br />still a balance of approximately five thousand dollars due. The city entered into an <br />agreed judgment entry that we would refrain from attempting to collect on that balance <br />because the defendant may be going into bankruptcy. We wanted to make sure we got <br />the money available from the insurance company, and then we'll see whether or not the <br />defendant does in fact go forward with bankruptcy. <br />8) January 13, he attended a Law Directors' Association meeting. A speaker at the <br />meeting discussed the 2004 Jaylin Investment vs. Village of Moreland Hills zoning <br />decision out of the Eighth District. It's an interesting zoning case. The Supreme Court <br />has taken it in for review. It may be another opportunity for the court to look at Shemo- <br />like issues. <br />9) January 14, he attended the first meeting of the Safe Staffing Committee with Fire <br />Dept. representatives in conjunction with the new collective bargaining agreement. The <br />group decided to attempt to schedule meetings in the evening so the Council <br />representatives have an opportunity to be present. <br />In answer to an inquiry by Councilman Dailey, Law Director Dubelko explained that the <br />Law Dept. had devoted about 63 hours from February to mid-May defending the Musial <br />vs. North Olmsted case. From that point until the end of August, it was handled by the <br />outside firm of Walter & Haverfield. He estimates his department spent approximately <br />60 more hours on the case during the following three months. Outside counsel has been <br />paid or is in the process of being paid slightly over $27,000 for fees and costs. He is <br />satisfied with the result and will not recommend further appeal by Council as he feels the <br />city's interests have been protected. <br />Finance Director Copfer: 1) The preliminary unencumbered balances for each fund were <br />reported to the county at the end of yesterday. Council has a copy of the reports and the <br />greenbars. Other than a cursory review, she hasn't had an opportunity to analyze them. <br />2) She met with the administration regarding the budgeting process. She is working on <br />gathering information for the estimated resources for 2005. <br />In response to an inquiry from Councilman Miller, Finance Director Copfer said that the <br />carryover from 2004 was $1.1 million <br />4 <br />
