Council Minutes of 1/4/2005 <br />For 2004, it's a tie between "union negotiations" and "public records." This yeaz's report <br />includes additional information on real property maintenance enforcement as Council had <br />expressed an interest in that issue. Also, there is a more extensive listing of civil cases <br />that were resolved in the Law Dept. in 2004 and those that remain pending as of <br />December 31, 2004. He encourages Council to look at the page which talks about <br />recommendations for continuing to improve good government in the city. <br />5) He and Assistant Law Director O'Malley have conducted second interviews of <br />candidates for the position of City Prosecutor. A decision should be made by week's end. <br />6) December 23, participated in the employee's holiday breakfast. As usual, there was a <br />great effort put on by members of many city departments. <br />7) December 27, provided additional legal advice to the Finance Director regarding Mr. <br />Dial's public records request. <br />8) December 27, provided a memo to City Council explaining in greater detail the <br />November 23 decision of SERB on the unfair labor practice that had been filed by the <br />city against the Firefighters Local 1267. <br />9) December 27, issued legal opinion 2004-07 on the legality of expenditures out of the <br />Senior Assistance Fund, an issue raised by Councilman Gazeau several months ago. <br />10) Happy New Yeaz to all, and he looks farwazd to working with everyone this yeaz to <br />do, if not great things, at least good things for the City of North Olmsted. <br />Councilwoman Kasler questioned the Mayor as to whether or not a project labor <br />agreement has been considered or is going to be considered for the fire station project. <br />Mayor Musial answered that it has not been considered as of the present time. He will <br />take a look at it, but at the moment, no decision has been made. Mrs. Kasler noted that <br />some Council members felt it was an appropriate project to consider a project labor <br />agreement and thought the question should first be posed to the Mayor. Mayor Musial <br />commented that a PLA was considered for the library project. Although it was not used, <br />approximately 94% to 96% of the companies used were union. Regarding the <br />construction manager concept, he felt that worked well with the library project as it was a <br />complex structure. The fire station project will cost about $2 million, and he is not sure <br />whether it warrants the additional expense of a construction manger. But this issue will <br />be discussed with Council. Councilwoman Kasler said she agreed with him regarding the <br />construction manager. She believes the PLA should be considered for the fire station <br />project as it will probably span the trades even though it is a smaller project. Councilman <br />Dailey commented that the Mayor frequently speaks of the "big four"-city, schools, <br />local businesses and labor. Thies is a great opportunity for us to bring labor into this <br />equation. It's not a huge project, and it's not one of the biggest projects we're ever going <br />to see. He thinks it would be a great opportunity for the unions to be brought on boazd. <br />Finance Director Copfer: 1) The Finance Dept. is spending many hours finalizing the <br />budget, closing the 2004 year, opening the new year, creating W2 library files, loading <br />the employee master, the general ledger and the accounts payable vendor master into our <br />new system. Also, department members have been attending training sessions. The <br />training room is equipped with a speaker system which saves time and money as the <br />trainers do not to have to travel here. <br /> <br />5 <br />
