Council Minutes of 11/8/20(16 <br />Councilman Barker thanked the Safety, Service, Engineering and Police Departments for <br />their fast response to a problem with traffic traveling on Columbia Road and ending up in <br />residents' yards. New signage will be provided to correct the problem. <br />Law Director Dubelko: 1) Welcome back to Councilman Gareau. <br />2) Thanks to the Mayor for comments regarding Issues 109, 110. Thanks to Council for <br />persisting with him and allowing him to get these final issues before voters for the third <br />time. Had to educate himself as to what he was doing wrong the first and second time <br />they didn't pass before he could educate the public. The Finance Director made a good <br />suggestion, rather than make the state purchase program an exception to competitive <br />bidding, to instead state it in a way that it was deemed to satisfy the competitive bidding <br />requirement. Several people suggested the issues be split so they could be better <br />understood. <br />3) Since last meeting, provided legal advice to several members of Council including <br />Councilman Orlowski who mentioned the legal advice to prohibit the storage of rock salt <br />on commercial property. That will be discussed in committee. Councilman Orlowski <br />also posed a question regarding Resolution 2006-177 which ratifies payment for new Life <br />Paks in the Fire Dept. as to whether or not the Board of Control required approval of this <br />action by the Fire Chief. This is not necessary since City Council under the Charter is in <br />charge of the methods of disposing of surplus property. Chapter 955 of the code carves <br />out a section in which directors can go to the Board of Control and get authority to <br />dispose of surplus property less than $1,500. It doesn't detract from Council's ultimate <br />authority to regulate the disposal of surplus property in the city. He has a request for a <br />legal opinion from Councilman Orlowski relating to the Mayor's policy regulating <br />contact between members of the administration and Council on issues when Council <br />people are attempting to get information to perform their duties. He established a <br />comment period so that everybody who is involved in this issue can weigh in. He plans <br />to get a formal legal opinion out shortly that addresses both the needs of City Council as <br />well as the needs of the administration on this issue. <br />4) The odor nuisance issue was discussed in caucus. The Law Dept. did a lot of research <br />on that issue. He is satisfied the legislation before Council tonight is at least a good step <br />for Council to take a look at it and perhaps get more input and do something legislatively <br />that addresses the problem Council perceives is occurring with respect to nuisance odor. <br />5) Attended Board of Control and directors' meetings on October 25 and November 7. <br />At the November 7 Board of Control, there was a presentation of Springvale Ballroom <br />rentals for the second and third quarters. This was done in accordance with Council's <br />ordinance placing Board of Control in a somewhat supervisory position over ballroom <br />rentals and to make recommendations back to the Springvale Mgr. and City Council if <br />necessary. <br />6) On October 19, attended a meeting of WCOG with the Mayor and Human Resources <br />Director. <br />7) Conducted contract reviews for Service and Recreation items. <br />8) Had discussions with the attorney of Suburban Auto relating to its conditional use <br />permit. That is going into BZD Committee for further discussion. <br />3 <br />
