Council Minutes of 11/8/20Q6 <br />AU_ DIENCE PAi~TICiPAT(~N <br />Dennis Lambert, 25057 Carey Lane, expressed concern about Ordinance 2006-179 which <br />deals with nuisance odors. He believes it might cause neighbors to hassle one another <br />about ordinary odors such as from a barbecue grill or an outside fireplace. He suggested <br />the ordinance might be more than what Council thinks, and he is concerned the ordinance <br />may not be enforceable or would be selectively enforced. He suggested Council take a <br />close look at the legislation in committee and bring forth legislation that does not create a <br />nuisance for the police and the people of North Olmsted. <br />Law Director Dubelko appreciated Mr. Lambert's remarks because good legislation <br />needs public comment. Presently, the city has legislation in place that regulates noxious <br />odors, but it has a very indefinite standard and poses some of the risks of arbitrary <br />enforcement suggested by Mr. Lambert. The proposed modification/addition to that <br />legislation is more specific and deals with air contaminant sources and control <br />equipment. Input from the public is good and will make sure what is being legislated <br />does in fact narrowly address a true evil that the city is trying to address, that it isn't too <br />broad, and that needed exemptions are included. <br />LEGISLATION <br />Resolution No. 2006-170 introduced by Mayor O'Grady was given its third reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for the <br />reconstruction of Great Northern Boulevard from NOMBL Lane to Country Club <br />Boulevard (excluding the bridge over Interstate 480) in the City of North Olmsted as <br />detailed in the plans and specifications on file, further authorizing the Mayor to enter into <br />a contract with the lowest and best bidder for said repairs, and declaring an emergency. <br />Council Member Dailey Jones moved for adoption. The motion was seconded by <br />Councilman Ryan and passed unanimously. Resolution No. 2006-170 adopted. <br />Resolution No. 2006-174 introduced by Mayor O'Grady was given its second reading. A <br />resolution authorizing the city Building Department to request certification from the Ohio <br />Board of Building Standards for enforcement of the Residential Code of Ohio, in order to <br />exercise enforcement authority, accept and approve plans and specifications, and to <br />conduct inspections. Councilman Miller moved for suspension of the rule requiring three <br />readings. The motion was seconded by Councilman Orlowski and passed unanimously. <br />Councilman Miller moved for adoption. The motion was seconded by Councilman <br />Barker and passed unanimously. Resolution No. 2006-174 adopted. <br />Resolution No. 2006-177 introduced by Mayor O'Grady was given its second reading. A <br />resolution authorizing payment to be made to Medtronic Emergency Response Systems, <br />and ratifying and affirming the purchase by the North Olmsted Fire Chief of a Life Pak <br />12 Unit from said company and the trade-in of an old Life Pak Unit to said company, and <br />declaring an emergency. Councilman Orlowski moved for suspension of the rule <br />requiring three readings as it had been heard in committee. The motion was seconded by <br />Councilman Barker and passed unanimously.
