Council Minutes of 10/3/2006 the measurement of sound levels: Section SSS.03 (e), to reconsider distance ~~ measurement from a residential lot line; Section SSSA3 (e) (3), as this may pertain to the loading and unloading of salt and other deicing products during specific hours; Section SS5.03(f), Distance Measurement; Section SSS.10(b) line 6 and 7 regarding notification to include of near or contiguous property owners and/or business owners; Section SSS.10(f), Guidelines and Criteria for Application far Special Variance, was referred to the Safety Director for clarification, documentation and guidance. The committee voted unanimously to hold in committee pending further review. 2) A Public Safety, Health & Welfare Committee meeting was held this evening October 3. Present were committee members Barker, Talton and Orlowski; Council Members; the Mayor, Service Director, Human Resources Director, Community Life Services Director; guests and residents. Discussed were two liquor permit transfers: • Partners Inc., DBA No Excuses, 27330 Lorain Road, to Rice Enterprises LLC, DBA Phoenix, at the same address. • Multi-Culture Food Inc., DBA Wild Mango Restaurant and Bar, Westfield Great Northern Mall, 140 Great Northern first floor and mezzanine to 362 Great Northern Mall. This is the same owner in a new location in the mall. There was information from Lt. Gallagher of the Police Dept. that there were no problems with these transfers. The committee voted unanimously to have no objection on both transfers. Councilman Orlowski moved that Council have no objection to the liquor permit transfer from Partners Inc., DBA as No Excuses, 27330 Lorain Road, to Rice Enterprises LLC, DBA Phoenix, 27330 Lorain Road. The motion was seconded by Councilman Barker and passed unanimously. Councilman Orlowski moved that Council have no objection to the liquor permit transfer of Multi-Culture Food Inc., DBA Wild Mango Restaurant and Bar, Westfield Great Northam Mall, moving from 140 Great Northern first floor and mezzanine to 362 Great Northern Mall. The motion was seconded by Councilman Barker and passed unanimously. Council Member Dailey Jones thanked Council and the administration for the quick action that was taken in contacting ODOT regarding the sound barrier walls on behalf of the residents of Ward 3. AUD~ENC~ PARTICIPA,~TIQ1V Dennis Lambert, 2SOS7 Carey Lane, commented that he felt we were in a representative government, which he feels is good government. He feels Councilman Orlowski is doing a good job of representing the people of his ward in which he lives. In every good organization, you have the best people doing whatever there is to do. If everyone is competent and qualified, no good leader has to fear the information that anyone of those people give as being any less than representative of the administration. Charles Dial, 27959 Gardenia, spoke regarding the carryover as reported by the Finance Director. He encourages Council to spend to the extent it is appropriate on true, legitimate thought-out needs of the community. As in the past, he expressed concern about the cost of wasting time in committee and Council meetings. 13
