Public Hearing of 9/19/2006 <br />Ordinance No. 2006-135 <br />Planning Director Wenger answered the structures would be for utility purposes such as a <br />CEI substation. It would be a conditional use. <br />Councilman Miller inquired whether that would include cell towers. <br />Planning Director Wenger said not specifically as there is a separate wireless <br />telecommunications overlay. So, unless it qualified to be in the overlay, in and of itself it <br />would not be a permitted or conditional use. <br />Mrs. Givens inquired as to how many structure of single and two-family could be put on <br />an acre. <br />Planning Director Wenger answered that there is a minimum lot size under area <br />regulations. For asingle-family dwelling unit, the minimum lot size criteria will be <br />13,200 square feet. It's roughly larger than a quarter acre. For atwo-family dwelling, <br />the minimum lot size would be 14,700 square feet. Divide that by 43,560 to get the <br />acreage. Probably about three on an acre. <br />Janet Dorn, 30990 Bradley Road., asked if there were specific size requirements for <br />hospitals, health centers, nursing homes. <br />Planning Director Wenger answered it is indicated for all other uses that the minimum <br />square footage would be 40,000 square feet, which is just under an acre. The conditional <br />uses were taken under 1142.04. Many of them are conditional uses in Single Family <br />Residential Districts, A, B and C. She will need to check and look back at those districts <br />to see if there are additional size requirements that would be appropriate to include. But <br />as those are conditional uses and more restrictive districts, it seemed appropriate to <br />continue them in a less restrictive district. The short answer is 40,000 square feet unless <br />it's determined the use does not fit a site that size. <br />Mrs. Dorn asked the meaning of public/semi-public or office use within a major <br />subdivision. <br />Planning Director Wenger said, previously under permitted uses, it's broken down into <br />(a) residential uses, (b) public and semi-public and (c) office uses. There was a concern <br />that anon-residential use may locate in a residential major subdivision such as Timber <br />Trails. What the committee did not want to happen is to have an office use or a semi- <br />public use locate on a lot right in the middle of a residential subdivision without giving it <br />extra scrutiny. So, in addition to saying that it's a conditional use, there cannot be an <br />impact on surrounding properties. We have adouble-safe under development standards <br />under traffic as it says, "any and all buildings used for non-residential purposes shall <br />front onto or have access from a collector or arterial street." There may be a comer lot in <br />a major subdivision, but it would have to access not through the local neighborhood <br />traffic but onto the collector street.
