Council Minutes of 9/5/2006 <br />• Arbitration awazd came down from arbitrator Carrie McDonald against the city. <br />This is one of eight management rights grievances/arbitrations from 2004. It <br />involved an attempt by the Fire Chief to deal with staffing issues by changing a <br />policy in the Fire Dept. dealing with the number of fire fighters who could be off <br />on any given day. The arbitrator has agreed with the union that the policy cannot <br />be changed without bargaining. The city has 30 days to decide whether it will <br />appeal into Common Pleas Court. <br />2) Prosecutor's report for August: 247 cases handled, 60% traffic, 40% general offenses <br />case. There were five trials, four convictions and one acquittal. <br />3) Attended records commission meeting on August 16. <br />4) Have reviewed a lot of contracts for Rec, Service, WCOG, WWTP, Police and Safety. <br />5) New Asst. Law Director Heyward is doing a very good jab getting up-to-date in both <br />fair housing matters and real property maintenance code prosecutions. <br />6) Provided some research and advice to the administration dealing with guardrails or <br />roadside barriers at certain locations in the city. <br />Councilman Gazeau expressed concern over a lawsuit filed against the Rocky River Court <br />regarding the way fees are charged that, if there is a finding of liability against the court, <br />the judgment will have to be paid by North Olmsted and the other member communities. <br />Law Director Dubelko said he was aware of the situation and is checking into it. <br />Finance Director Copfer: 1) In addition to normal weekly meetings, she has attended <br />meetings regarding the Records Commission, Fire Dept. minimum safe staffing, Rec Trac <br />Software implementation and training, engineering contract negotiations, Recreation <br />master planning and the Tax Incentive Review and Housing Council. <br />2) Before Council this evening is the city's 2007 county tax budget which needs to be <br />passed after committee review at the next council meeting. The purpose is primarily to <br />determine that debt service requirements are being met and that the city demonstrates <br />need for the county to levy property taxes in an appropriate amount. Updated estimates <br />of property appraisals to determine the amount that will ultimately be levied once the <br />appraisals will be finalized will not be available until November. <br />3) The Auditor of State's Office officially released the 2005 audit on August 14. Copies <br />have been provided to the Mayor and Council, and it is available on our website as well <br />as the Auditor of State's website. <br />4) On August 31, the June and July financial statements and summaries were distributed <br />to Council and the administration. On Sept 1, a PDF file of the revenue and expenditure <br />reports were sent to Council. <br />5) The sewer credit application is on our website under forms/documents/finance/sewer <br />refund. The Mayor's office will place a notation on the front page to draw people's <br />attention to the requirements and the deadline of Sept 30 and to direct them to that section <br />on the website that has the application and requirements. <br />President Kennedy asked far a moment of silence to recognize a local fallen hero, <br />Cleveland Police Officer A.
