Council Minutes of 6/6/2006 <br />5) Attended a briefing at NASA today on behalf of the Mayor to discuss the new project <br />leadership being .assigned at NASA Glenn that will utilize existing employees. There <br />was no discussion of increases in staffing, though it appears this may reduce or eliminate <br />the remaining projected job cuts, which is good for residents of North Olmsted who work <br />at NASA. Official labor estimates won't be available until the fall, although they seemed <br />enthusiastic that this is just Phase I of the constellation space exploration initiative and <br />that NASA Glenn will be more likely to ..get more work because it is the next generation <br />space exploration. Unfortunately for Fairview, the buildings on the north side of <br />Brookpark will be closed and all NASA activity is being moved over to the south side <br />which is in a different city. That is a very big loss to Fairview, but there are opportunities <br />of other entities that do want to come in there. <br />Councilman Ryan questioned Finance Director Copfer on whether or not she had <br />received the requested information from the Rocky River Court. Mrs. Copfer said she <br />had been diligent in trying to obtain the information and will continue to do so. Mr. Ryan <br />suggested, if she received the information in time, she discuss it at the upcoming Finance <br />Committee meeting. <br />Council President Kennedy reported on the Committee-of-the-Whole: 1) The committee <br />met today at 7:15 p.m. to discuss the proposed tattoo parlor located at 30584 Lorain <br />Road. Present were Council Members Ryan, Tallon, Barker, Miller, Jones, Orlowski and <br />Kennedy. The proposed owner Mr. Wulff fielded questions from various Council <br />members with regards to business hours, age of clientele, potential clientele, as well as <br />the set-up of the proposed store. At the committee meeting, a motion was made by Mr. <br />Ryan and seconded by Mrs. Jones not to reaffirm the Planning & Design Committee's <br />recommendation for approval of the tattoo parlor. The motion failed to a vote of 4-3. <br />Councilman Barker moved to approve Wulff Tattoo Studio proposed location at 30584 <br />and 30585 Lorain Road, North Olmsted, per all recommendations of boards and <br />commissions. Law Director Dubelko suggested the motion be stated more generally as a <br />motion to approve the ruling of the Funning & Design Commission that tattoo parlors are <br />a like and similar use in a General Retail Business District and therefore permitted. <br />Councilman Barker so moved. The motion was seconded by Councilman Tallon. <br />Councilman Orlowski asked the Law Director if Council was considering a tattoo parlor <br />on a one-case scenario at a time. Law Director Dubelko answered no, that under Chapter <br />1123.10 of the Zoning Cade, where a particular use is not provided for any of the <br />districts, the applicant has the right to request a ruling as to whether or not that use is <br />permitted in a particular district. So, the ruling of Planning & Design Commission, <br />regardless of how they worded the motion, determined that tattoo parlors are permitted in <br />a General Retail Business District. Roll call: Barker, yes; Tallon, yes, with comment <br />that he knows Mrs. Jones received a lot of calls about this. But Council received a report <br />from the Law Director stating the reasons far which this could be turned down. The <br />reasons all have to be substantiated. The Law Director indicated that, if this was not <br />passed, it could be considered infringing on First Amendment rights and the city could be <br />opened up to a lawsuit and compensation for withholding business fmrn operating in the <br />city. Therefore, he votes yes because he basically doesn't see an out. Roll call <br />5 <br />~~ <br />
