Council Minutes of 4/18/2006 <br />Councilman Ryan asked, by making this change, wouldn't it permit the local Civil <br />Service Commission to set rules of conduct and rules to remove them? Law Director <br />Dubelko answered that authority already is in the Charter in Section 3, which is not being <br />touched. The amendment is to Section 4, Procedures. This enables the Commission, in <br />conducting its affairs, to have local rules of procedure which may be different than state <br />law. Councilman Ryan said, those local procedures say how to conduct the meeting or <br />how to substantively set rules as it applies to the safety forces, and should we be taking <br />that kind of chance? Shouldn't we be very careful when we turn over to a third party <br />how to set rules for removal? That's what the concern is. Law Director Dubelko said <br />that concern was addressed a long time ago because our classification scheme and the <br />authority to the Civil Service to have those responsibilities to provide by rules for <br />removals, etc. has been in the Charter at least since 1985. That maybe unsatisfactory and <br />it may be that the Charter Review Commission in the future may want to look to having a <br />local Civil Service Commission that in acting upon its duties in Section 3, follows state <br />law. Section 4 is only to make that small change in the conduct of its affairs to do it in <br />accordance with local rules so long as the local rules are not in conflict with the city <br />Charter. Councilman Ryan asked: is it a procedure change of when to set the tune of the <br />meetings, who should attend, and things like that or will the change cause or give the <br />local Civil Service Commission the legal authority to start setting substantive rules that <br />can impact against the safety forces or anyone else in a Civil Service position. Law <br />Director Dubelko said it will not affect that change because that authority rests in the CS <br />Commission pursuant to Section 3. <br />Christine Novak, 23087 Esther. On Thursday, April 13, she and her neighbor videotaped <br />people blatantly ignoring the road closed signs on Claque. She e-mailed Mayor, but <br />didn't get a response. She brought the videotape to present to the Mayor. It is just a <br />sample of what goes on over there. She knows it is in vain because a new phase of the <br />construction project will be starting, and a new phase means new traffic problems. The <br />residents see them as traffic problems, and we can't turn our heads and say out of sight <br />out of mind. Also, the media needs to be told the correct information regarding the <br />Claque Road project. The websites for Channel 3 and radio station 106.5, plus on air <br />with 106.5 states: "In North Olmsted road closed due to reconstruction on Claque <br />southbound between Lorain and I-480." Also, a neighbor recently heard a radio re~rting <br />stating that Claque southbound would be closed until the end of April. Someone needs to <br />contact them and give right information so we don't have people corning up and down a <br />closed road. <br />Mayor O'Grady thanked Mrs. Novak for coming to the meeting and for the a-mail. He <br />has not contacted her as he was waiting for the answer to the question he put to the Safety <br />Director and Police Chief as to whether the tape might be admissible of someone <br />violating our codes. Once he gets an answer, he will get back to her. He will turn the <br />tape over to the Safety Director. About misinformation, sometimes the press gets things <br />wrong. She is right in saying it is incumbent upon the administration to do better to make <br />sure they're getting it right. He heard what she said and will try to be more aggressive in <br />getting out correct information. <br />C7 <br />17 <br />c, .. <br />
