Council Minutes of 10/2/2007 <br />people driving through the community. Ideas in the plan included adding trees and <br />landscaping and adding ivy to the new walls. <br />Councilman Gareau said he thought it would be an appropriate step to formally express <br />Council's acceptance and approval of the Crocker-Stearns corridor study prepared by the <br />Urban Design Center of Northeast Ohio. It has been presented at several public hearings <br />as well as the Committee-of--the-Whole. It is a guide, it's a road map, it's not the end but <br />the beginning. He noted that the Planning & Design Commission did unanimously <br />approve it with one small exception. They wanted to clarify that sterile flower trees <br />should be used. Councilman Gareau made a motion to adopt the Crocker-Stearns corridor <br />study as prepared by the Urban and Design Center of Northeast Ohio, dated April, 2007, <br />and include that in the record together with the Planning & Design Commission minutes <br />which include their recommendation. (See attachment to the minutes.) The motion was <br />seconded by Councilman Ryan. Roll call: Gareau, yes; Ryan, yes; Tallon, yes; Barker, <br />yes; Orlowski, yes; Jones, yes, with comment. She would like to thank everyone who <br />worked on this committee for many, many months and is glad to see it finally come to <br />fruition and approval by Council. As Mr. Gareau stated, it's a great guide for our city, <br />for our Planning Director, for economic development for the future of this area. She is <br />very pleased to see it happen. Roll call continued: Miller, yes, with comment. He too <br />would like to thank everyone who has been involved in this process. Hopefully, it's a <br />great beginning of things to come for our city. He thinks the value of this whole thing <br />can be understated. The motion passed unanimously. <br />Councilman Miller, chairperson of the Environmental Control Committee: 1) The <br />committee met on September 25. Items discussed included: <br />• Ordinance 2006-179, an ordinance amending Section 521.09 of Chapter 521 of <br />the General Offenses Code entitled "Noxious or Offensive Odors" in order to <br />deem as a nuisance condition emissions into the atmosphere from any air <br />contaminant source or control equipment that cause outdoor air to become <br />unreasonably odorous and declaring an emergency as amended. The discussion <br />was relatively brief in that this issue has been before Council in one form or <br />another for quite a while. It was decided that this method of determining nuisance <br />odors was best used with the test being that which interferes with a person of <br />ordinary sensibilities-their ability to comfortable enjoyment of life, health, <br />property, and safety. Under this plan, if there is an offense indicated by a resident <br />or anyone else who is offended, the test being the reasonable person, the Police <br />Dept. would then be called as opposed to the Building Dept. There are some <br />different options that the officer can take. He can refer it to the Prosecutor, or he <br />can cite the offender at the time, and the city can then, if they choose, go to the <br />Common Pleas Court and ask for an injunction. There are a variety of steps that <br />can be taken. There are residents who have been affected by this. for so long in <br />the case of Suburban Auto Body. But this is not directed at one business. The <br />committee unanimously recommended approval of the legislation by Council. <br />• Ordinance 2007-108, a resolution authorizing the Mayor to enter into an intra- <br />governmental agreement with the Cuyahoga County Solid Waste Management <br />5 <br />~~~ <br />
