,.
~.

MINUTES OF THE .MEETING OF THE COUNCIL
OF THE CITY OF NORTH OLMSTED
AUGUST 21, 2007
Present: President of Council Kennedy, Council Members Barker, Gareau,
Dailey Jones, Miller, Orlowski, Ryan, Tallon
Also Present: Mayor O'Grady, Law Director Dubelko, Finance Director Copfer, Clerk of
Council Seman
President Kennedy called the meeting to order at 8:10 p.m. in Council Chambers, 5200
Dover Center Road, North Olmsted, Ohio.
Members of the audience were invited to join Council in the recitation of the Pledge of
Allegiance.
President Kennedy asked if there were additions or corrections to the Council minutes of
August 7, 2007. Mayor O'Grady requested a change on Page 13 under Miscellaneous
Business, to include his personal response to two issues raised by Councilman Orlowski
that he would like written answers to questions he posed and his request that the Safety
Director listen to a tape of a committee meeting to find questions and answers. The
Mayor's response was the written answers Councilman Orlowski is requesting, he has
already received; the Mayor would not have his Safety Director taking time to listen to a
tape of a meeting in search of questions. But, if Councilman Orlowski had questions,
they would respond. A discussion ensued as to if and how the minutes should be
corrected. The Law Director said there was no requirement that the minutes be approved
this evening. Councilman Orlowski said he believed what had transpired was he
requested information and stated not all had been given to him. It was suggested by
Council Members Gareau and Ryan that the Clerk withdraw the minutes and review
them. The Clerk preferred not to withdraw the minutes but wished to correct them as
directed by City Council. Councilman Ryan made a motion that Council accept the
minutes as presented by the Clerk as being true and accurate. The motion was seconded
by Councilman Orlowski. Roll call: Ryan, yes; Orlowski, yes; Miller, yes; Gareau, no,
with comment that he would prefer to not have this vote right now so that he could
actually look to determine whether or not it is an accurate reflection. He has great faith in
the Clerk of Council; it's not a question about her ability. Somebody raised the fact that
they think something might be missing. The audio tape will reveal that. But we won't
have that opportunity to listen to the tape and make sure. Roll call continued: Jones,
abstained as she was nat in attendance at that meeting. Roll call continued: Barker, no.
Law Director Dubelko commented that Council Member Jones' vote should be taken as a
no vote. Council Member Jones said, if it was going to be taken as a no vote, she would
vote no. Roll call continued: Tallon, yes, with comment that the minutes can always be
amended at a later date. If the Mayor has approval of the tapes that the wording is there,
