Council Minutes of 8/21/2007 <br />comprehensive municipal liability, automotive liability and physical damage, public <br />officials errors and omissions, police professional liability, property, inland marine, boiler <br />and machinery, broad form crime, EDP, umbrella, liquor liability and other various <br />insurance coverage required by the City of North Olmsted, as a package, and authorizing <br />the Mayor to enter into a contract for said insurance package with the lowest and best <br />bidder, and subject to approval by the Board of Control. Councilman Tallon moved for <br />suspension of the rule requiring three readings noting the legislation had been reviewed <br />in committee. The motion was seconded by Councilman Ryan and passed unanimously. <br />Councilman Tallon moved for adoption. The motion was seconded by Councilman Ryan <br />and passed unanimously. Resolution No. 2007-92 adopted. <br />Ordinance No. 2007-93. Councilman Gareau called for a point of order noting the vote <br />to amend the ordinance had not been taken so it could not be read as amended. <br />Councilman Orlowski, chairperson of the Public Safety Committee, agreed that the <br />committee had voted to amend the ordinance. The ordinance was amended so that the <br />time frame would run from August 25, 2007 terminating the position on Sept. 19, 2007. <br />And counting the time the administration hired the part-time Fire Administrator as a <br />contract employee would equate to approximately 60 days of employment with the new <br />Assistant Fire Chief. Also agreed at this meeting, was the end of hiring the part-time Fire <br />Administrator as a contract employee. It was amended to read, "The temporary, part- <br />time Fire Administrator so appointed or re-appointed shall be qualified by training, <br />certification, and experience to conduct plans reviews and fire inspections." Mr. <br />Orlowski made a motion to amend as stated above. President Kennedy asked him to <br />remake the motion. Councilman Orlowski said the amendment included a motion <br />(during committee) by Mr. Tallon to rehire the part-time Fire Administrator as a city <br />employee beginning August 25, 2007; terminating the position on September 19, 2007; <br />and counting the time the administration hired the part-time Fire Administrator as a <br />contract employee, the committee agreed to approximately 60 days of employment with <br />the new Assistant Fire Chief. Also agreed at the committee meeting was the end of <br />hiring the part-time Fire Administrator as a contract employee. In Section 1 on page 2, <br />the Law Director made some changes and it starts out with, "...shall commence on <br />August 25, 2007 and terminate on September 19, 2007. The temporary part-time Fire <br />Administrator so appointed or re-appointed shall be qualified by training, certification, <br />and experience to conduct plans reviews and fire inspections." Law Director Dubelko <br />asked to add as a friendly amendment to the motion: all as set forth in the document <br />titled as amended and no more so than what's in this. Mayor O'Grady commented he felt <br />there were additional words being inserted by Mr. Orlowski that he doesn't think have <br />been approved. Councilman Orlowski said these are words that were part of the motion <br />that was agreed to at the committee meeting. That's why he read them as he did. <br />Councilman Gareau seconded the motion. Councilman Gareau called the question. <br />President Kennedy said he was going to read the motion as amended in the final copy by <br />the Law Director and asked if Mr. Orlowski was comfortable with it. Councilman <br />Orlowski said he was comfortable with it if it includes the terminology that he stated that <br />was agreed to. President Kennedy said the final copy will be the motion. Councilman <br />Gareau said the suggestion is that, if Council is comfortable with the language as it <br />appears in the document not marked as amended, but marked as amended corrected copy. <br />21 <br />
