Council Minutes of 6/19/2007 <br />vegetation would have been significant. He cannot envision a mound of 9 feet along that <br />property. Mr. Joyce wondered if a 4 or 5 foot mound with a fence on it could be <br />addressed. He has seen other mounds around the city, for example at Wal-Mart and <br />Target. Councilman Gareau said it would be an issue of reasonableness, and he does not <br />think there is a way to protect from the sounds. Also, we have run out of money; the <br />project is pretty well expended. Mayor O'Grady commented that Service Director <br />Limpert would have someone from the Engineering Dept. call Mr. Joyce and go through <br />the current plan and discuss his concerns. He said, even after the project is complete, if <br />there is something that's not working for Mr. Joyce, he should let the city know and we <br />will do everything we can reasonably to address the issue. <br />LEGISLATION <br />Ordinance No. 2007-30 introduced by Mayor O'Grady on behalf of himself and Council <br />Members Miller, Gareau, Orlowski, Tallon, Barker and Jones was given its third reading <br />An ordinance amending Section 1135.02 of Chapter 1135 (One and Two Family <br />Residence Districts) of the Zoning Code in order to regulate the placement of portable <br />storage containers in One and Two Family Residence Districts of the City of North <br />Olmsted as amended. Councilman Gareau moved for adoption. The motion was <br />seconded by Councilman Orlowski and passed unanimously. Ordinance No. 2007-30 <br />adopted. <br />Ordinance No. 2007-41 introduced by Mayor O'Grady was given its third reading. An <br />ordinance authorizing the Mayor to enter into a ground lease with option agreement with <br />T-Mobile and approving site development to locate a cellular monopole tower and <br />facilities at Fire Station #2, and declaring an emergency. Councilman Barker, moved for <br />adoption, and the motion was seconded by Councilman Gareau. Roll call: Barker, no; <br />Gareau, no; Ryan, no; Jones, no; Tallon, no; Orlowski, no. The motion failed with six no <br />votes. Ordinance No. 2007-41 not adopted. <br />Resolution No. 2007-59 introduced by Mayor O'Grady was given its third reading. A <br />resolution authorizing the Chief of Police to apply for law enforcement grant funds from <br />the State of Ohio for Drug Abuse Resistance Education (DARE) for fiscal 2007-2008 <br />and, if the application is granted, further authorizing the Mayor to enter into an agreement <br />with the State of Ohio, or the appropriate State of Ohio law enforcement agency, to <br />accept said grant funding on behalf of the city. Councilman Orlowski moved for <br />adoption. The motion was seconded by Councilman Barker and passed unanimously. <br />Resolution No. 2007-59 adopted. <br />Resolution No. 2007-62 introduced by Mayor O'Grady was given its third reading. A <br />resolution extending for an additional three month period the contract with Richard L. <br />Bowen & Associates, Inc., and Daniel J. Collins to, respectively, provide engineering <br />consulting services to the city and serve as City Engineer. Councilman Tallon moved for <br />adoption. The motion was seconded by Council Member Jones and passed unanimously. <br />Resolution No. 2007-62 adopted. <br />14 <br />
