Council Minutes of 6/19/2007 <br />Responding to a request from President Kennedy, Law Director Dubelko explained the <br />procedure for reconsideration of legislation vetoed by the Mayor. The Charter provides <br />that it must be reconsidered at the next meeting of Council. There is no discretion to not <br />reconsider; the vote is a formality. After the vote to reconsider, the President puts the <br />question to Council whether or not to sustain the Mayor's veto. <br />Councilman Gareau made a motion to reconsider Ordinance 2007-50 which was vetoed <br />by the Mayor. The motion was seconded by Councilman Barker. Roll call: Gareau, yes; <br />Barker, yes; Jones, yes; Orlowski, yes; Ryan, asked for clarification on the vote and voted <br />no. Roll call continued: Tallon, no. The motion passed with four yes votes and two no <br />votes. <br />President Kennedy presented the question to Council: Should Ordinance 2007-50 be <br />adopted notwithstanding the veto of the Mayor? Roll call: Barker, no; Gareau, no; <br />Jones, no; Orlowski, yes; Ryan, no, with comment. If the administration feels that <br />strongly about it that they are going to use their veto power, which has only been used <br />once, at this time it is not important for Council to override a veto the administration feels <br />that strongly about. Roll call continued: Tallon, yes. The veto was sustained with four <br />no votes and two yes votes. Ordinance No. 2007-50 is not adopted. <br />Law Director Dubelko: 1) On May 23, Assistant Law Director Heyward made a real <br />property maintenance presentation to the administration and to some members of <br />Council. She has reviewed the contract for the new economic development consultant, <br />which has been approved and executed. She is continuing to work on a real property <br />maintenance initiative which will hopefully be presented to the administration for its <br />review by fall. Ms. Heyward is working with the Building Commissioner on the new <br />rental registration ordinance that became effective on June 1. The expectation is that this <br />year we will simply get the knowledge out to the community that there is an obligation to <br />register if you are the owner of a single family home in North Olmsted and are renting it. <br />Next year, the city will begin to charge the annual fee for that registration. <br />2) The Law Dept. drew down the third year of the HUD capacity building grant, <br />$117,000. In the last three years, we have drawn down $354,000 in grants which should <br />go a long way to spreading the message of fair housing throughout the city. <br />3) Assistant Law Director O'Malley's litigation report: Szarka trustees v. the Board of <br />Zoning Appeals, there has been a case management conference and a briefing schedule <br />has been established by agreement between the parties and then ordered by the court. <br />4) In the case of North Olmsted v. IAFF Local 1267, the court ruled on several ancillary <br />motions but has not yet ruled on the motion to vacate. <br />5) Arbitration of a fire fighter grievance is scheduled for Monday, June 25. <br />6) Prosecutor's report for May: A total of 290 cases, no cases tried in May. There were <br />116 pleas, 12 sentences, 128 pending, 38 cases were dismissals and 2 bind-overs. In <br />May, 2006 there were 183 traffic and 88 general offense charges. In 2007, there were <br />191 traffic and 99 general offense. <br />7) The Suburban Collision Center retest was done last week. Our consultant was there to <br />look over the shoulder of the collision center's consultant, and a representative of the <br />nearby neighborhood was there also. <br />3 <br />
