Council Minutes of 4/17/2007 <br />LEGISLATION <br />Ordinance No. 2007-5 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending Chapter 1136 (Single Family Cluster District) of the Zoning Code in <br />order to establish new regulations for Single Family Cluster housing developments in the <br />city as amended. Councilman Gareau moved for adoption, and the motion was seconded <br />by Councilman Barker. Roll call: Gareau, yes; Barker, yes; Miller, yes; Jones, yes; <br />Tallon, yes; Orlowski, no, with comment. He believes this ordinance lessens the <br />requirements to place a development within the city of North Olmsted. The shrinking of <br />the requirements and new methods of calculating space for development may increase the <br />allowable density. This new version eliminates several sections from the current Single <br />Family Cluster District which he believes should remain. He believes this contains <br />arbitrary and capricious language on modifying code requirements by commissions. The <br />motion passed with five yes votes and one no vote. Ordinance No. 2007-5 adopted. <br />Ordinance No. 2007-20 introduced by Councilman Gareau was given its second reading. <br />An ordinance amending Section 1126.11 (Deviations From Approved Plans Prohibited) <br />of Chapter 1126 of the North Olmsted Zoning Code in order to require that developers <br />certify that site development plans and building elevations submitted to the city Building <br />or Engineering Departments incorporate all requirements of the final development plan <br />approved by City Council. <br />Ordinance No. 2007-25 introduced by Councilman Barker was given its second reading. <br />An ordinance amending Section 505.16 of Chapter 505 (Animals and Fowl) of the <br />General Offenses Code, entitled "Vicious and Dangerous Animals," in order to require <br />registration of pit bulls, wolf-hybrids and vicious animals kept in the City of North <br />Olmsted, and to impose liability insurance and other requirements upon the owners of <br />such animals, and declaring an emergency, as amended. Councilman Barker moved for <br />suspension of the rule requiring three readings noting the legislation had been reviewed <br />by committee. The motion was seconded by Councilman Orlowski. Roll call: Barker, <br />yes; Orlowski, yes; Tallon, yes; Jones, yes; Miller, yes, with the understanding that this <br />continues to be a work in progress and it may return back to Council for more additions. <br />Roll call continued: Gareau, yes. The motion passed unanimously. Terry Groden, <br />25211 Chase Drive, came forward and said he believed this discussion was in large or in <br />full part because of something that happened in Deerfield Park. He wanted to take the <br />opportunity to thank the members of Council and the Law Director for their time and <br />effort on this legislation. Dennis Lambert, 25057 Carey Lane, said Mr. Miller had raised <br />a good issue regarding the strength of leashes. He would suggest, if it goes back for <br />reconsideration, that not only the strength of the restraints, but also the individual holding <br />the leash should be reviewed. In 506.16 (i)(3), it specifies the restrictions and says the <br />animal owner shall maintain adequate control and restraint at all times so as said animal <br />shall be under complete control of the owner at all times. However, you would not want <br />a 3 foot person weighing 69 pounds hauling a bulldog around. Mr. Miller said that issue <br />was discussed and, under advice from the Law Dept. and working with the Animal <br />Warden, the committee came up with the age of 17. Councilman Barker moved for <br />adoption. The motion was seconded by Council Member Jones.
