City Council Minutes of 1/16/2007 <br />Councilman Talton made a motion to reconsider Ordinance 2006-122. Roll call on the <br />motion to reconsider Ordinance 2006-122: Talton, yes; Gareau, yes; Barker, yes; Jones, <br />yes; Miller, no with comment. He has expressed his concerns throughout this process. <br />He has discussed it at committee meetings. He has discussed. it with. Council at the <br />various committee meetings. It should not come as a surprise as to his vote on this. He is <br />uncomfortable with it in numerous aspects that he has expressed. Roll call continued: <br />Orlowski, no; Ryan., no. The motion passed with. four yes votes and. three no votes. <br />Ordinance No. 2006-122 is reconsidered. <br />Councilman Gareau made a motion to refer Ordinance No. 2006-1.22 back to the BZD <br />Committee, and. the motion was seconded by Councilman Barker. Roll. call: Gareau, <br />yes; Barker, yes; Jones, yes; Ryan, no; Talton, yes; Orlowski, no; Miller, yes, <br />commenting that he would like to direct a question to the Law Director. The motion <br />passed with five yes votes and two no votes. Ordinance No. 2006-1.22 is referred back to <br />BZD Committee. <br />Councilman .Miller's question to the Law Director was: Had there not been enough. votes <br />to put it back in committee, what would have happened to it? <br />Law Director Dubelko said some action. would have had to take place as the legislation <br />was on third reading. Council could have tabled it, put it back into committee, or <br />amended. it. But some affirmative action had to be taken, which was done by placing it <br />back into committee. <br />Councilman Miller explained he had. voted yes on the motion to return it to committee as <br />he dial not feel it was appropriate to just .leave it out there in limbo. It needed some <br />action. Certainly it's f ne that it is going back into committee. <br />Councilman. Gareau thanked the members of Council for their consideration.. Hopefully, <br />the concerns can be addressed. <br />MISCELLANEOUS BUSINESS <br />Councilman Barker made a motion. that Council reappoint Mr. Thomas Dubowski to the <br />Landmarks Commission for the term. January 1, 2007 through December 31, 2008. The <br />motion was seconded by Councilman Ryan and passed unanimously. <br />Council Member Dailey Jones scheduled a joint Streets & Transportation and Finance <br />Committee meeting on Tuesday, January 23, 2007, at 7 p.m. The Streets & <br />Transportation Committee and Finance Committee will discuss the roadway rating <br />condition and rehabilitation projects for the coming years. The Streets & Transportation <br />Committee will discuss 2007-1. Councilman Talton asked that the Finance Director be <br />present for the Finance Committee portion for the discussion of Resohrtions 2007-2, <br />2007-3, 2007-4, and Ordinance 2006-202. Council Member Jones requested that Service <br />Director Limpert and City Engineer Collins attend. <br />14 <br />
