City Council Minutes of 1/16/2007 <br /> <br />Councilman Gareau, chairperson of the Building, Zoning & Development Committee: 1) <br />The committee met this evening, January 16, 2007. Present were committee members <br />Orlowski, Miller and Gareau; Council President Kennedy and Council Members Jones <br />and Barker; Planning Director Wenger, Law Director Dubelko. Three items were on the <br />agenda: <br />• Ordinance 2005-165, an ordinance amending Chapter 149 of the Administrative <br />Code (Planning Commission), repealing Chapter 1125 of the Zoning Code <br />(Architectural Review Board), and amending Chapter 1126 of the Zoning Code <br />(Commercial and Other Building Permits) in order to effectuate the affirmative <br />vote of the North Olmsted electorate at the November 2005 general election upon <br />Issue 97, the Charter Amendment proposal relating to the new Planning & Design <br />Commission. This legislation takes care of some "housekeeping." When the <br />Charter amendment took affect after a vote of the people, we no longer had the <br />Planning Commission as we knew it-we had the Planning & Design <br />Commission. The Architectural Review Board was no longer in existence. This <br />legislation was brought forward some time ago to effectuate that and to establish <br />what had already taken place through the Charter Amendment. The committee <br />unanimously recommended approval of Ordinance 2005-165 as amended. <br />• Ordinance 2006-200, an ordinance amending Section 1321.05 of Chapter 1321 <br />(Permit and Inspection Fees) for the purposes of establishing a separate fee <br />schedule for various city boards and commissions and for increasing some of the <br />fees of the said boards and commissions. Building Commissioner Conway gave <br />the following explanation and opinion of the legislation: "The changes in <br />1321.05 (A) reflect increasing valuations which are suggested due to the <br />inflationary costs related to construction since we last modified this construction. <br />This will have no cost affect to the applicant and, in effect, may reduce costs in <br />some borderline cases. It is a realistic attempt to reflect the rising cost for <br />construction. The other changes relate to inspections and re-inspection fees that <br />are not covered by building permit fees. These adjustments in most cases are <br />moderate but are requested after studying each area and determining that the <br />current charges do not cover the costs related to these inspections. The current <br />cost of inspectors is in excess of $30 per hour including benefits and the <br />secretarial staff time to process these complaints, and these increases certainly can <br />be justified." An explanation was also provided by Planning Director Kimberly <br />Wenger. The committee voted unanimously to recommend approval of <br />Ordinance 2006-200. <br />• Suburban Collision Center. Some time ago, the committee had discussed the <br />testing requirement that Suburban Collision would, after a period of one year, <br />engage in a new round of tests to determine if there were any emissions from the <br />facility. In November, the committee brought forward this issue to discuss an <br />extension of time whereby additional changes could be made and we could test <br />with the new changes to the facility and we could also do it in a different climatic <br />situation. We are currently in winter, and the odor that people are detecting <br />seems to be affected by temperature and humidity. The committee discussion <br />centered upon whether or not we would extend the timeframe to perhaps June or <br />5 <br />
