Council Minutes of 12/16/200$ <br /> <br />friendly correction to add the self-insured workers' compensation fund. <br />Councilman Gareau accepted the correction and thanked her for the reminder <br />noting the city is moving into a new format for workers' compensation fund and <br />using self-insurance. That separate fund to get that up and running is an <br />additional amendment. Councilman Barker seconded the motion. The motion <br />passed unanimously. Ordinance No. 2008-161 amended. <br />• Ordinance 2008-162, an ordinance to make appropriations for current expenses <br />and other expenditures for the City of North Olmsted for the year ending <br />December 31, 2009. This legislation is the temporary budget which does <br />encompass much of what was discussed during the committee meeting. <br />Councilman Gareau made a committee motion to hold the legislation in <br />committee. The motion was seconded by Councilman Kearney and passed 3-0. <br />The legislation will be discussed at the Finance Committee mee#ing at 7:30 p.m. <br />on Tuesday, December 23. All are welcome to attend. <br />Councilman Gareau made a motion to adjourn the meeting for an executive session for <br />the purpose of discussing labor negotiations. The motion was seconded by Councilman <br />Barker. Roll call: Gareau, yes; Barker, yes; Kearney, yes; Ryan, no; Jones, yes; <br />Mahoney, yes; Orlowski, yes. The motion passed with six yes votes and one no vote. <br />Council adjourned into executive session at 8:22 p.m. <br />Council reconvened to the call of the President at 8:SS p.m. <br />Councilman Orlowski, chairperson of the Environmental Control Committee: 1) The <br />committee met on December 8, 200$ at 8:21 p.m. In attendance were committee <br />members Barker and Orlowski; Council Members Gareau, Kearney, Mahoney; the Law <br />Director, Service Director; a guest. Agenda items included the following: <br />• Ordinance 2008-156, an ordinance amending Section 949.03 (Cutting and <br />Trimming Required) of Chapter 949 of the North Olmsted Streets, Utilities and <br />Public Services Code in order to more efficiently provide for the removal of dead, <br />dying and/or fallen trees from private property. The committee reviewed <br />amendment 949.9 (a) (4), any dead or dying tree to remain on the property where <br />it poses a substantial risk to the public health or safety, or any fallen tree to <br />remain on the property for more than fourteen days. The committee was in <br />agreement with this amendment. During the committee meeting, two more <br />amendments for Section 949.03 were presented and were referred to the City <br />Forester and the Law Director for their input. The chairman recommended <br />changes for Section 949.01, Removal of Diseased Trees These changes would <br />update this section of the code to current EPA standards. The last time this <br />section was reviewed was in 1964. The committee recommended with a vote of <br />2-0 to hold the ordinance in committee pending the amendments. <br />• Resolution 2008-163, a resolution authorizing the Director of Public Safety to <br />advertise for bids for the purchase of a maximum of 35,000 gallons of sodium <br />aluminate for a twelve month period for use by the Wastewater Treatment Plant <br />for phosphate removal; and authorizing the Mayor to contract for same, and <br />4 <br />
