Council Minutes of 8/19/2008 <br />vehicles. He believes Mr. Limpert will meet with the Crossroads representatives. He <br />wants to make this a matter of record these issues are addressed with this resurfacing. He <br />does appreciate that Martin and Oring are being resurfaced and he thanks Council for the <br />appropriations and everything they have done. He would just like to ga on record to <br />make sure these items are addressed for the safety of the children and people who live <br />there. All the taxpayers who are paying for this want the integrity of the road left <br />maintained. Hopefully, this road is going to last a good 15/20 years. With the amount of <br />pitch on the edge of these drop-offs, the gravel. that is there is going to become <br />compromised, thus the asphalt will be compromised and then the edges will be lost and <br />the road will cave in. <br />Mayor O'Grady thanked Mr. Zillmann for his comments and assured him the issues he <br />raised: the safety and the service aspect and the actual installation are things that will. <br />definitely be seriously looked at. He will. also speak to the City Engineer with regard to <br />his comments. He assured Mr. Zillmann he will make sure that the project is done to <br />specifications. <br />LEGISLATION <br />Ordinance No. 2008-72 introduced by Councilmen Barker and Mahoney was given its <br />third reading. An ordinance amending Section 1117.05 of the Zoning Code in order to <br />more effectively comport with Fourth Amendment Constitutional requirements. <br />Councilman Barker moved for adoption. The motion was seconded by Councilman <br />Mahoney and passed unanimously. Ordinance No. 2008-72 adopted. <br />Ordinance No. 2008-73 introduced by Councilmen Barker and Mahoney was given its <br />third reading. An ordinance amending Section 1331.13 of the Building Code in order to <br />more effectively comport with Fourth Amendment Constitutional requirements. <br />Councilman Barker moved for adoption. The motion was seconded by Councilman <br />Mahoney and passed unanimously. Ordinance No. 2008-73 adopted. <br />Ordinance No. 2008-69 introduced by Councilmen Mahoney and Barker was given its <br />third reading. An ordinance providing for the submission to the electors of the City of <br />North Olmsted of an amendment to Article VI, Section 3 of the Charter of the City of <br />North Olmsted to provide for the Fire Chief to become a member of the unclassified <br />service of the city, and declaring an emergency. Councilman Mahoney moved for <br />adoption, and the motion was seconded by Councilman Barker. Roll call: Mahoney, <br />yes; Barker, yes; Kearney, no; Ryan, no; Jones, yes; Orlowski, no; Gareau, yes. The <br />motion failed with four yes votes and three no votes as the motion needed atwo-thirds <br />majority to pass. Ordinance No. 2008-69 is not adopted. <br />Ordinance No. 2008-70 introduced by Councilmen Mahoney was given its third reading. <br />An ordinance providing for the submission to the electors of the City of North Olmsted of <br />amendments to Article IV, Sections 3 and 9, of the Charter of the City of North Olmsted <br />to confer additional powers and duties upon the office of the President of Council in <br />order to improve the conduct of the business operations of the City Council, and <br />16 <br />
