Council Minates of 8/19/2008 <br />declaring an emergency. Councilman Mahoney moved for adoption, and the motion was <br />seconded by Council Member Dailey Jones. Roll call: Mahoney, yes; Jones, yes; <br />Barker, no; Ryan, no; Gareau, no; Kearney, no; Orlowski, no. The motion failed with <br />five no votes and two yes votes. Ordinance No. 2008-70 is not adopted. <br />Ordinance No. 2008-83 introduced by Mayor O'Grady was given its third reading. An <br />ordinance providing for the submission to the electors of the City of North Olmsted of an <br />amendment to paragraph (a) of Article III, Section 5 to eliminate the Charter requirement <br />that removals of department heads by the Mayor be subject to the consent or approval of <br />City Council; and declaring an emergency, as amended. Councilman Mahoney moved <br />for adoption, and the motion was seconded by Councilman Gareau. Roll call: Mahoney, <br />yes, with comment that this was one of the two pieces of legislation recommended by the <br />Charter Review Commission. For that reason and the reasons stated by the commission, <br />he is in favor of this, so his vote is yes. Roll call continued: Gareau, no; Orlowski, no; <br />Kearney, no; Ryan, no, with comment. He agrees with the intent of this, but he thinks it <br />has to be reworked a little farther. He thinks the Mayor's heart is in the. right place, but <br />this isn't there yet, so he is compelled to vote no at this time. Roll call continued: Jones, <br />no; Barker, no. The motion failed with six no votes and one yes vote. Ordinance <br />No. 2008-83 is not adopted. <br />Ordinance No. 2008-84 introduced by Mayor O'Grady was given its third reading. An <br />ordinance providing for the submission to the electors of the City of North Olmsted of <br />amendments to Article III, Section 5, and Article V, Sections 1, 4, 5, and 6 of the Charter <br />of the City of North Olmsted to grant authority to the Mayor to create, eliminate, and/o~- <br />merge departments headed by appointed directors; to further grant to the Mayor the <br />exclusive authority to assign duties to the appointed directors; to further abolish the <br />Departments of Public Service, Public Safety and Community Life Services as Charter- <br />level departments; and declaring an emergency. Councilman Barker moved for adoption, <br />and the motion was seconded by Councilman Mahoney. Roll call: Barker, no; Mahoney, <br />no, with comment. This legislation was not recommended by the Charter Review <br />Commission. One can obviously see that he does place a lot of deference and place high <br />value on the recommendations of that body. His vote is no. Roll call: Ryan, yes, with <br />comment. He believes the administrator of this city should have the ability to run anti <br />administer the city on a daily basis. He thinks as long as City Council retains the right to <br />make sure the people who are placed in those positions that are approval. by the Mayor <br />should be gone ahead. He thinks this was an acceptable piece of legislation the Mayor <br />put forward, and he believes that that every Mayor should have this ability, if someone is <br />not cooperating and doing the right job in his department, he should have the right to <br />remove him immediately. He votes yes. Roll call continued: Jones, no; Orlowski, no; <br />Kearney, no; Gareau, no. The motion failed with six no votes and one yes vote. <br />Ordinance No. 2008-84 is not adopted. <br />Ordinance No. 2008-92 introduced by Mayor O'Grady was given its second reading. An <br />ordinance amending Section 745.02 of Chapter 745 of the Business Regulation Code <br />(Hotel and Motel Tax) in order to expand the government purposes for which the city's <br />local Hotel/Mote1 Tax is imposed, as amended.
