Council Minutes of 8/19/2008 <br /> <br />government purposes for which the city's Hotel/Motel Tax is imposed. In the <br />past, this particular fund was restricted to capital purchases, capital <br />improvements, equipment, and items of that nature. The administration came <br />forward and requested that the purpose of the HoteUMotel Fund be expanded to <br />include a more general usage within police and fire divisions and emergency <br />dispatch. However, they requested the issue of wages and benefit not be included. <br />The committee by a vote of 3-0, with the motion made by Councilman Gateau <br />and seconded by Councilman Kearney, recommended approval as amended. The <br />amendments include the permitted purposes of expenditures for police, fire, and <br />dispatch divisions with the exception that wages and benefits shall not be a <br />permitted purpose for which funds maybe expended. Councilman Gateau made a <br />motion to amend Ordinance 2008-92 as stated. The motion was seconded by <br />Councilman Kearney. Roll call: Gateau, yes; Kearney, yes; Orlowski, yes; Ryan, <br />no; Mahoney, yes; Jones, yes; Backer, yes. The motion to amend passed with six <br />yes votes and one no vote. Ordinance No. 2008-92 is amended. <br />• Ordinance 2008-93 which was recommended for approval as amended in <br />committee with a motion by Councilman Gateau, seconded by Councilman <br />Barker, and passed 3-0. The ordinance amends Section 1 of Ordinance No. 97-34 <br />which established the Hotel/Motel Tax Fund as previously amended by Ordinance <br />No. 2006-113 in order to further expand the purpose for which monies in the said <br />fund maybe expended. This was a companion piece of legislation required to be <br />amended so that the city could in fact in the future expend from that fund any <br />police and fire division and emergency dispatch purposes with the exception of <br />wages and benefits. Councilman Gateau made a motion to amend Ordinance <br />2008-93 as stated. The motion was seconded by Councilman Barker. Roll call: <br />Gateau, yes; Barker, yes; Mahoney, yes; Kearney, yes; Jones, yes; Ryan, no; <br />Orlowski, yes. The motion to amend passed with six yes votes and one no vote. <br />Ordinance No. 2008-93 is amended. <br />• Ordinance 2008-94, an ordinance amending Section 2 of Ordinance No. 99-107 <br />which established the Safe Traffic Oriented Policing Program (STOP) in the <br />North Olmsted Police Department as previously amended by Ordinance No. <br />2004-42 in order to further expand the purpose for which monies paid into the <br />STOP Fund may be expended. Originally, any revenue that was generated by <br />virtue of the STOP program was limited in the past to those officers and <br />equipment that were specifically used in the STOP program. It could be used for <br />purchase of a police car, but that police car was supposed to be designated for the <br />STOP program. It could be used for equipment that was related to STOP. It was <br />also used for payment of wages and benefits for the police officers that were put <br />on the traffic detail. It was later amended to include a certain percentage of the <br />Prosecutor's salary and benefits which were attributable to court appearances on <br />the STOP program. The change would expand it for the purpose of including <br />emergency dispatch. The amendment would be as follows: "...provided, <br />however, that when in any given year surplus monies as determined by the <br />Director of Finance to exist in the fund over and above those that ate required to <br />pay compensation to police officers and the city Prosecutor as above described. <br />and to meet the existing annual debt service, if any, for prior purchases of police <br />6 <br />
