i <br />Council Minutes of 8/5/2008 <br />Councilman Ryan made a motion to amend Ordinance 2008-83 as follows: "Each <br />mayoral appointment of the head of a department shall be subject to the consent and <br />approval of Council which may disapprove such an appointment only by a vote of not <br />less than two-thirds vote of its members." The remainder of the legislation would remain <br />as it is. The motion was seconded by Councilman Gareau and passed unanimously. <br />Ordinance No. 2008-83 amended. <br />Councilman Barker, chairperson of the Building, Zoning and Development Committee: <br />1) The Building, Zoning and Development Committee met on Wednesday, June 25, <br />2008, at 6:45 p.m. In attendance were committee members Barker and Gareau as Mrs. <br />Jones was unable to attend due to another meeting pertaining to Stearns Road; Council <br />members Kearney, Mahoney and Orlowski; Planning Director Wenger and Assistant Law <br />Director O'Malley. The agenda for the evening was a proposed hotel and Ordinances <br />2008-56, 2008-57, 2008-72, and 2008-73. <br />• The proposed hotel would be on Great Northern Blvd. next to Moen. For this to <br />proceed, a judgment entry change has to take place on Parcel # 236-11-009. This <br />was just an informal meeting between Council and BIW Properties to see if <br />Council would be interested in seeing a plan for a hotel on that property. A <br />polling of members in attendance showed an interest in this proceeding. <br />• Ordinance 2008-56 is an ordinance amending Section 1139.01 of Chapter 1139 <br />(Business Districts) of the Planning and Zoning Code in order to regulate the <br />placement of charitable collection bin storage containers in the General Retail <br />Business District of the city of North Olmsted. Also, Ordinance 2008-57, a <br />companion ordinance to 2008-56, which reads: "An Ordinance amending <br />Sections 755.11 and 755.12 of Chapter 755 (Secondhand Dealers) of the Business <br />Regulation Code, entitled "Hours and Circumstances of Sales," and "Exceptions" <br />in order to regulate outdoor collection receptacles on commercial property." After <br />a lengthy discussion between Council members and Mr. O'Malley, it was decided <br />to hold it in committee so that questions and thoughts by Council could be <br />answered by Law, Safety and Building. The questions include regulating where <br />they could be placed, certain sized lots, permit application or not, appearance as <br />was done with the FOD ordinance, that they be emptied frequently and a distance <br />between boxes so that we don't have a cluttered look along the street. Also, <br />whether or not we really want to permit these bins throughout the city. A <br />committee motion was made by Mr. Barker to hold Ordinances 2008-56 and <br />2008-57 in committee, and it was seconded by Mr. Gareau. The vote was 2-0. <br />• Ordinances 2008-72 and 2008-73. Ordinance 2008-72 amends Section 117.05 of <br />the Zoning Code in order to more effectively comport with Fourth Amendment <br />Constitutional requirements. Ordinance 2008-73 is an ordinance amending <br />Section 1331.13 of the Building Code in order to more effectively comport with <br />Fourth Amendment Constitutional requirements. These amendments are being <br />added because during discussion of Ordinance 2008-44, the Law Director <br />discovered that some of the wording in the codes needed to change so as to be <br />better understood by all and to protect the residents' issues concerning the Fourth <br />9 <br /> <br />
