Councilman <br />Ryan moved that Council appoint Mr. Lou Brossard to the Charter Review Commission <br />for the term which ends December 31, 2008. The motion was seconded by Councilman <br />Gareau and passed unanimously. <br />Councilman Barker, chairperson of the Building, Zoning & Development Committee: 1) <br />The Building, Zoning and Development Committee met Tuesday May 27, 2008 at 7:25 <br />p.m. Present were members Barker, Gareau and Dailey Jones; Council Members <br />Kearney, Mahoney, Orlowski and President Kennedy; Law Director Dubelko; Mr. <br />Angelo Papotto owner, Mr. Richard Panza from the law firm of Wickens, Herzer, Panza, <br />Cook & Batista and Gary Lehky of Cleveland Spray Booth all representing Suburban <br />Collision Center located at 26618 Brookpsrk Ext. in North Olmsted, and neighboring <br />residents. On the agenda was the pc~ssihe extension of the temporary conditional use <br />permit for Suburban Collision Center negotiated between Mr. Panza and Law Director <br />Dubelko. Council granted a temporary conditional use permit to Suburban in October of <br />2005 for one year. At that time, a test was to be done to warrant the approval of a <br />permanent conditional use permit, Because of timing of the permits and time to get up <br />and running, it was determined in December of 2(}06 that the testing for the permanent <br />issuance would not be at the correct time. Council extended the temporary permit to June <br />of 2007. The test that was done in June of 2007 came back with mixed results from not <br />only their expert but also the city's expert. Discussions began between the city and <br />Suburban to look at what the test had shown and what could be done to show <br />improvement at the facility from that point on. After eleven months, we have come to the <br />point where the administration, the Law Department, and Suburban are suggesting that a <br />two-year temporary extension be given to Suburban Collision Center so that they can <br />install new spray booth equipment, move the stacks approximately 80 feet forward, and <br />retest again around the summer of 2010. This extension would be provided so that <br />Suburban has some incentive to spend approximately $362,000 for this major <br />improvement. Mr. Panza and Mr. Lehky, the person who will be installing the new <br />equipment, stated that odors and contaminates will now be close to 98% removed versus <br />the 60 to 65% now supposedly being removed. The city's expert has commented that the <br />system that is being proposed is an excellent system. During the discussion, comments <br />were made that we all have been told this before and that would explain the doubt that <br />many residents still have with this new proposal. It was explained by Mr. Lehky that, <br />with the existing equipment and the odor problems that Suburban is having, the <br />procedure that Suburban was using to try to solve the problem was actually creating a <br />bigger problem. Mr. Papotto was diligent in trying to solve the problem by adding <br />additional filtering which in theory was a good idea; but in actuality by adding the <br />additional filtering, it slowed down the air movement in the booths and that herd create <br />more of an odor problem. Mr. Panza, representing Mr. Papotto, said that his client is <br />installing a system that will far exceed any equipment in the city of North Olmsted. It <br />was stated that the present system meets all national standards, but it was pointed out by <br />Mr. Dubelko that it does not meet the local standard and the feeling is that this new <br />system will. Is it possible that after this new system is installed will no one complain? <br />Mr. Panza said he cannot make that claim and that is understood by all. What Mr. Panza <br />will claim is that once they are done, there will not be another body shop, dry cleaner or <br />7 <br />~w~v~ <br />
