Council Minutes of 5/20/2008 <br />LJ <br />case before Judge Sutula. However, this time we're having the opportunity to <br />file it before the judgment so hopefully, when Judge Villanueva rules in the case, <br />we won't have some of the language that concerned us with respect to our new <br />collective bazgaining agreement obligations and rights. <br />• City of North Olmsted v. Cleveland Hockey Supply. At last Council meeting, <br />authorization was given to the Law Dept. to file an action against that company <br />for amounts that were due to the city in connection with the lease that company <br />had formerly at the Rec Center. The complaint was filed in Rocky River Court on <br />May 8, and we aze seeking damages in the amount of $10,700. <br />2) Legal opinion 2008-01, issued last week, involves right of the Mayor under City <br />Charter to take part in all matters that come before City Council. The Charter does <br />provide for Mayor to be an equal partner in the legislative process in North Olmsted in <br />that he has authority to sponsor, to take part in all discussion of business before Council, <br />and to veto legislation. Even though Charter provisions often are stated in broad,. general <br />terms, it is important to recognize that the Mayor's right extends also at caucus meetings <br />and committee meetings where much of the real meat of the business of Council is done. <br />He always tries to balance all the rights and obligations of all parties involved in the <br />process when writing legal opinions. He thought it was important to note, whether at <br />Council, committee or caucus, the presiding officer has much discretion to regulate <br />debate. So long as he does it in a way that is fair to members of Council and fair to the <br />Mayor that each of the co-partners in government gets a fair and full opportunity to <br />present, then the presiding officer still has much discretion to determine how much time <br />the debate is going to be on an issue and to regulate a party's input accordingly. That is a <br />concern some time, and it was important to say in the legal opinion also. <br />Finance Director Copfer: 1) Attended the semi-annual Rocky River Court meeting of the <br />finance directors. The court is running in a projected deficit of about $162,000 year-to- <br />date, but summer is a busy time for them. The main issue is they had large severance <br />payouts with the change of the court in the beginning of the yeaz of approximately <br />$109,000, which is difficult for them to overcame. They didn't anticipate it initially in <br />the budget. They have not replaced the Chief Deputy Clerk which was Debbie Comery's <br />prior position. She is now the Clerk of Court and doing bath jobs. They are utilizing <br />part-time staff in lieu of replacing a vacant full-time position that the judges are sharing. <br />The number of cases on the civil side have gone up substantially this year, and they aze <br />attributing it to small claims and garnishments related to payday loan-type businesses. <br />Criminal traffic is up 8% as well. Fines in North Olmsted have stabilized and are <br />comparable to last year as they had been going down substantially every year. The court <br />is attempting to get reimbursed far both bailiffs from the county. They are only being <br />reimbursed for one presently, and this is inconsistent with other municipal courts in our <br />area. Both judges and the Clerk are committed to reduce expenditures if resources <br />continue to not meet the plan. <br />2) Prepared and presented the first quarter operating results and azeas of budget concerns <br />to Council at the Finance Committee meeting and also went over the list from the budget <br />hearings as it relates to what was assigned to Finance. <br />3) Attended the drug free workplace training last Friday put on by Concern, who is our <br />EAP, which is Employee Assistance Program.
