Council Minutes of 5/20/2008 <br />12) Majority of pavement on Stearns Road is down on the west side of the road. <br />Pavement on the south side of Lorain has been removed and is expected to be replaced <br />and ready for traffic within 30 days. Reconstruction of the north side of Lorain Road will <br />follow soon after. <br />13) With Service Director Limpert, he attended apre-construction meeting with the <br />County Engineer's office for the Lewis Road bridge replacement project. The tear down <br />and construction for the bridge is to begin this June. <br />14) Bids for the 2008 asphalt recycling project and asphalt overlay projects were opened <br />on April 30. City Engineer Collins reviewed the bids and his recommendations were <br />brought to the Board of Control where asphalt overlay was awazded to Kokosing and <br />asphalt recycling to Crossroads. <br />15) Legislation currently before Council, 2008-67 and 2008-68, were reviewed in the <br />Intra-Governmental Relations Committee this past week and were not recommended for <br />approval. He regrets he was unable to attend and speak to issues. Would ask that all of <br />Council reconsider and consider passage of both of these ordinances because they bath <br />represent good government. Both are designed to either correct swell-intentioned law <br />that may be misdirected or to rollback perhaps something that was excessive. Regarding <br />2008-67, it is understandable that Council appreciates the presence of directors at City <br />Council meetings. He has a policy in place which requires all directors to attend Council <br />meetings. Ordinance 2008-68 put legislative controls on the administrative vehicle fleet. <br />Having a pool of automobiles is a great idea, but having that control in the City Council <br />is not good government. <br />Councilman Ryan suggested that the flag presented by the 82°d Airborne be flown during <br />the Memorial Day ceremonies, and Mayor O'Grady thanked him for the recommendation <br />and said he would do so. <br />Law Director Dubelko: 1) Litigation report: <br />• City of North Olmsted and IAFF Local 1267 case. The motion to vacate an <br />arbitration award in the case before Judge John D. Sutula, an adverse judgment <br />was entered against the city. It has been appealed into the Court of Appeals. In <br />the interim, the city filed a motion to vacate the awazd because of events that <br />occurred after the judgment which made, in the city's judgment, the perspective <br />application of the judgment inequitable. The city had filed a motion to remand in <br />the Court of Appeals to have the 60B motion heard by Judge Sutula so we could <br />take the whole thing back up on appeal assuming that the 60B motion didn't go in <br />our favor. In connection with that, the pazties have agreed to a joint stipulation <br />that has been filed. The Court of Appeals had ordered Judge Sutula to rule on the <br />60B motion by May 16, but the judge asked for an additional 30 days and the <br />court gave it to him. We would anticipate that sometime in mid-June we should <br />get a ruling from Judge Sutula on our motion to vacate 60B and perhaps also on <br />the motion for sanctions that was presented against him, the city, and Asst. Law <br />Director O'Malley. <br />• Companion case involving the fire fighters, another motion to vacate an <br />arbitration award, is before Judge Villanueva. The parties have filed a joint <br />stipulation in that case too. It's essentially the same facts that were filed in the <br />3 <br />~~ <br />
