Council Minutes of 5/20/2008 <br />Kearney, Mahoney, Orlowski and President Kennedy; Law Director Dubelko and Safety <br />Director Thomas and guests. Agenda items: <br />• Ordinance 2008-44, which he decided to pull back into committee to discuss the <br />warning tag issue. This has been a highly misunderstood part of the change in our <br />code. The administration is on record as being against setting policy in the <br />ordinance and the committee and other members of Council understand. But, <br />although they heard from a small percentage of residents regarding this issue, it <br />was stated by Mr. Gateau and agreed by ail that they received more cads on this <br />issue than any other issues going back two to three years. With that being said, he <br />wanted to make clear to the residents that the ticketable offenses are for high grass <br />and weeds, trash and garbage in the front yard, vehicles on the driveway, address <br />display and commercial landscaping. A warning tag will be left at the door and <br />residents will have 48 hours to comply. Also emphasized is that, if a resident is <br />under any form of hardship ar the lawn mower is being fixed, please call the <br />inspector who will be listed on the warning tag and talk to him. Our Building <br />Dept. will listen and help in any way it can. It is not the intention to be handing <br />out tickets and collecting fines. This change in this ordinance is a tool to help <br />some people move along who would ordinarily just ignore the violations. After <br />lengthy discussion and debate during committee, Mr. Gateau m€se a motion to <br />recommend twice-amended 2008-44, with the request of suspension with the <br />amendment to be the requirement of first violation warning tags for the <br />ticketable offenses and for the Law Dept to draft language allowing for <br />immediate issuance upon exigent circumstances This was seconded by Mrs. <br />Jones and the committee vote was 3-0 to recommend approval. Council <br />received the changes from the Law Director on Friday, May 16. The c es <br />are as follows: Warning tags, .....(through the beginning of Penalty under <br />1351.99). Then instead of "emergency," it will read: If an "egregious" <br />condition exists as described above, or if the owner or operator of a property <br />fails to correct a citation within 48 hours following placement of a warning tag <br />upon the property... Also in, 1368.03(e), upon observation of A first violation <br />that is not deemed to be egregious because of similar prior violations at the <br />property within the past 12 months or because of the presence of multiple <br />violations at the property, a warning tag will be issued. <br />Councilman Barker made a motion to approve Ordinance 2008-44 with the changes to <br />Sections 1351.99(a) on page 2 of the legislation and 1368.03(e) on pages 18-19 in the <br />twice amended version of Ordinance 2008-44 which has been distributed by the Clerk to <br />all members of Council. The motion was seconded by Councilman Gateau who made a <br />friendly amendment that the motion should be to amend. Councilman Barker agreed. <br />The motion to amend was passed unanimously. Ordinance No. 2008-44 was twice <br />amended. <br />Councilman Orlowski, chairperson of the Environmental Control Committee: 1) The <br />Environmental Control Committee met on May 14, 2008 at 8:30 p.m. In attendance were <br />members Barker and Orlowski; Councilman Kearney; Service Director.
