<br />Council Minutes of 5/6/2008 <br /> <br />• In the Rocky River Municipal Court case of City of North Olmsted v. Suburban Collision <br />Center, there was a motion hearing today before Magistrate Barb Valponi on the <br />defendant's motion to dismiss for lack of jurisdiction. Asst. Law Director O'Malley <br />attended that hearing today. The court denied that motion and insisted that the defendant <br />enter a plea. The case now is being assigned to rule on a more typical motion to dismiss <br />on issues that the defendant has raised in that case. <br />• On April 24 in the case of City of North Olmsted v. Laser Wash, the court accepted the <br />party's plea bargain which is based upon the defendant submitting a minor change that <br />was acceptable to the city. The defendant was found guilty and fined $35. The fine was <br />small, but the important point was to get some respect for the city's minor change <br />process. <br />• Afire fighter's grievance regarding a comp time issue has been set for arbitration on June <br />10, 2008 before arbitrator Harry Graham. <br />2) Prosecutor Gordillo's monthly report: 278 total cases handled in Rocky River Municipal <br />Court this past month; 127 General Offenses; 151 Traffic. Two cases were tried and there were <br />two convictions. <br />Finance Director Copfer: 1) On April 28 at the request of the EPA's financing division, known <br />as DEFA, she and the Service Director met with ATS Engineering Consultants, the EPA <br />Enforcement Division and DEFA to bring the Enforcement Division up to speed with the plan to <br />ensure that their concerns are adequately addressed in the plan that is being financed by DEFA. <br />2) April 28, met with the STC operations director regarding the potential for them taking over <br />the operations of NOCOP. The purported savings to NOCOP could be $25,000. However, this <br />needs to be evaluated and will be presented to the NOCOP Board of Trustees. <br />3) April 29, AFSCME ClericaUTech negotiations were cancelled by the union representative, but <br />she participated in Dispatch negotiations in the afternoon. <br />4) April 30, attended a Records Commission meeting where the Planning Dept. and all the <br />boards and commissions retention schedules were approved. Donna Rote did an excellent job <br />taking and applying these public records laws and rules to each of the boards and commissions <br />separately. It was a very good presentation by her. The Commission is now moving on to <br />Human Resources and Service. <br />5) On May 2, she and Carole Heyward met with bond counsel to discuss contractual issues to be <br />addressed in the YMCA agreement and the draft ballot language that will have to be prepared. <br />6) May 5, the Mayor and Directors met to discuss revenue enhancement potential to mitigate <br />increasing costs. <br />7) May 6, attended FEMA Incident Command Training. She is the designated person to say yes <br />or no if the money can be spent. <br />8) The Board of Elections has revised the charge-backs for the 2007 election. Originally, our <br />cost was about a hundred and three thousand dollars. However, it has been revised to $88,300. <br />This was a great savings, but previously costs for the city's share has never been more than <br />$34,000. <br />9) The financial review of the first quarter is going to be discussed next week at the Finance <br />Committee meting. <br />Councilman Ryan, noting open government is good government, requested a copy of the <br />minutes of the meeting with the EPA Enforcement Bureau. Finance Director Copfer explained <br />that it was an administrative meeting and there were no minutes. Mayor O'Grady suggested that <br />Mr. Ryan speak to any of the people who attended the meetings and they would be able to <br />answer his questions. Councilman Ryan expressed the opinion that some type of minutes should <br />
