o Q <br />Council Minutes of 5/6/2008 <br />10) Last week, the Planning Director attended the American Planning Association National <br />Conference, picking up new ideas and new techniques in the area of zoning and planning. <br />11) There were 384 DARE graduates representing St. Brendan's, Pine School, and Chestnut <br />Elementary School. <br />12) New K-9 officer Rex and Officer Saringer will begin work on May 23. <br />13) National Incident Management System, an incident command system training, began today <br />at Springvale. A trainer from the Office of Homeland Security is conducting the program. <br />14) This is Building Safety Week in North Olmsted. We recognize all Building and Safety <br />personnel. <br />15) This is Multiple Chemical Sensitivity Month. MCS is a chronic disorder with no known <br />cure. Greater knowledge and understanding of this disorder will lead to more compassionate <br />treatment and hopefully a cure. <br />16) Presently, 826 residents have registered for the Do Not Knock program. Also, fewer vendors <br />have registered to peddle in North Olmsted. <br />17) Significant work is being done on the intersection of Lorain and Stearns roads. Temporary <br />pavement on the west side of Stearns has been removed, the base has been brought down to <br />grade, and sub-base material is being brought in. <br />18) Bases for the I-480 sound walls are going in, with a sample panel installed. After ODOT <br />review, other panels will be installed. <br />19) Street sweeper has begun making the rounds throughout the city. <br />20) Service Dept. has been patching at a rate of 8,000 pounds of hot patch a day, weather <br />permitting, and working the way through the city. <br />21) Bids for 2008 asphalt recycling project and asphalt overlay projects were opened on April <br />30. City Engineer is analyzing bids to select the lowest and best. <br />22) There was discussion at our last meeting regarding taking one issue and reviewing an aspect <br />of the issue at more than one Council committee. Thanks to Councilman Ryan for his decision <br />not to move in that direction. <br />Councilman Ryan commented that he had discussed the situation with Finance Committee <br />chairperson Gazeau; and, if there is a need in the future, the issue can be addressed in that <br />committee. <br />Law Director Dubelko: 1) Litigation report: <br />• City of North Olmsted and IAFF, Local 1267, case in front of Judge Sutula. Walter <br />Haverfield has entered an appearance on behalf of the city and filed motion to hold in <br />abeyance the defendant's motion for sanctions against the city, against the Law Director, <br />and against Asst. Law Director O'Malley pending the Court of Appeals decision on the <br />city's motion to remand the appeal back to Judge Sutula to address the pending 60(B) <br />motion as well as the ancillary motion for sanctions. The city filed the motion to remand. <br />The Court of Appeals did recently rule in the last couple of days granting the motion to <br />remand, so the case is being sent back from the Court of Appeals to Judge Sutula to <br />address the 60(B) motion, presumably also the motion for sanctions. Once those post- <br />judgment motions are disposed of, then the case will go back up on appeal before the <br />Court of Appeals. <br />• Another fire fighter azbitration award vacation case is in the Court of Common Pleas <br />before Judge Villanueva. The city filed a motion for leave to supplement the record in <br />that case to include the fact finding report of fact finder Robert Stein as it maybe relevant <br />evidence in that pending Court of Common Pleas action. <br />2 <br />
