J <br />Council Minutes of 5/6/2008 <br />considered was a significant improvement to the children's area-re-laying out the children's <br />area and enhancing the area quite a bit. This legislation is brought forward simply to proceed <br />with advertising for bids and construction. The committee did decide, and the library <br />recommended, that the city not proceed with the construction of adrive-through window which <br />was originally brought forward in November/December of last year. The original thought was to <br />proceed with that because we might be able to service a senior population that perhaps couldn't <br />get out of a vehicle or those who might have small children in the car. But it just simply was not <br />able to be done as it was not something that the library felt they could staff. It would require a <br />considerable expenditure of operating funds to fully utilize that window. So, the window was <br />removed. The committee unanimously recommended approval with the following amendment: <br />"Except as provided below, the bid documents shall in addition include a notice of all bidders <br />that prices for construction of the drive-through window and the detached structure for storage <br />shall be bid separately as alternates for the project. The Board of Control shall not award, and <br />the Mayor shall not enter into a contract including the said alternates without further expressed <br />authorization by Council." Councilman Gazeau made a motion to amend Resolution 2008-53 to <br />include the noted amendment. The motion was seconded by Councilman Barker and passed <br />unanimously. Resolution No. 2008-53 amended. Councilman Gareau noted the committee had <br />recommended passage under suspension of the rule. <br />Councilman Barker, chairperson of the Building, Zoning & Development Committee: 1) The <br />Building, Zoning & Development Committee met Tuesday, April 8, 2008 at 7 p.m. In <br />attendance were members Barker, Gareau and Dailey Jones; Council Members Kearney, <br />Mahoney, Orlowski, and President Kennedy; Law Director Dubelko, Planning Director Wenger; <br />guests. Discussed were Ordinances 2008-18, 2008-36, 2008-37, 2008-44, which were reported <br />out on April 15, 2008. Also discussed that evening were development plans for BF Products <br />North America Inc., which will be renamed to "am pm", located at 29131 Lorain Road; the T- <br />Mobile cell tower installation, located at 29708 Lorain Road: <br />• The BF Products North America proposal (CQ,,, , fiifl7~ consists of demolishing <br />existing structures in the development azea and constructing a new gasoline service <br />station. Representatives were Nathan Reid and Andrew Barnett from WD Partners and <br />Rick Turner and Brian Lindley from BP America. The development area includes three <br />parcels: two parcels fronting Lorain Road are zoned General Retail Business and the <br />third parcel fronting Stearns Road is zoned Single Residence. Rezoning of the residential <br />property is required, and the rezoning is covered under Ordinance 2008-18. This facility <br />will be a 24 hour 7 day a week operation. Ordinance 2008-1$ will rezone 5764 Stearns <br />Road from Single Residence to General Retail Business. Rezoning and redevelopment of <br />the Stearns Road corridor is supported by the 2005 Master Plan, and more specifically the <br />Crocker Stearns Corridor Plan, which were both approved by City Council. The two <br />commercially zoned parcels encompass approximately 22,500 squaze feet, which is <br />below the minimum lot size requirement for commercial lots of 40,000 square feet. The <br />addition of the residential lot makes the total development area less non-conforming. The <br />2,900 square foot building is mostly red brick, with a stone veneer base, an EIFS sign <br />band and canopy. The building entry will face Lorain Road and all commercial activity <br />will take place to the north of the building. There is no vehicular access to the rear of the <br />building. There will be no outdoor sales at this site. Propane and ice storage is to the <br />west of the building and will be accessed by employees only. The dumpster enclosure is <br />brick with a stone coping to match the building. New landscaping is proposed around the <br />perimeter of the site. A 2-foot mound with dense evergreen screening is proposed to <br />5 <br />
