<br />Council Minutes of 5/6/2008 <br />~~* <br />~~~ <br />shield residential neighbors to the south. Sufficient numbers of parking spaces are <br />included as well as a loading zone. Two full access curb cuts are proposed, one onto <br />Lorain Road and one onto Steams Road. Brickscape is provided along the Lorain Road <br />right of way around to the Stearns curb cut. All signage conforms to code requirements, <br />which include one ground sign, one wall sign, and two canopy signs. The proposal <br />resulted in variances for side and reaz building setback, front and side yard setback, and <br />light trespass, which were approved by the BZA lazgely due to the size of the lot. Lot <br />consolidation should be a condition of approval. At the committee meeting, Mr. Gazeau <br />made a motion to recommend approval of BP Products North America Inc; at 29131 <br />Lorain Road, proposal involves construction of a new gasoline service station subject to <br />the recommendations of Planning and Design, further with the request that the building <br />site proceed that the current structures are removed and a requirement to have a lot <br />consolidation. The committee motion was seconded by Mr. Barker and was unanimously <br />approved. Councilman Barker made a motion approve the proposal of BP Products North <br />America Inc., 29131 Lorain Road, consisting of a proposal involving construction of a <br />new gasoline service station subject to the recommendations of Flanning and Design <br />Commission, further with the request that the building site proceed, that the current <br />structures are removed and a requirement to have a lot consolidation, as shown on the <br />plans stamped April 4, 2008, and consistent with all of the recommendations of the <br />boards and commissions. The motion was seconded by Councilman Gazeau. Roll call: <br />Bazker, yes; Gareau, yes; Jones, yes; Orlowski, yes; Kearney, yes; Ryan, no; Mahoney, <br />yes. The motion passed with six yes votes and one no vote. <br />• T-Mobile (CQMSI;-QiIQ,3,~~ located at 29708 Lorain Road. This proposal consists of <br />constructing a new cell tower and associated site improvements for T-Mobile. Mr. John <br />Sindyla represented T-Mobile and the Martynowski's represented Patton's Towing where <br />the tower will be placed. The proposed site improvements involve two neighboring <br />parcels. The cell tower compound will be contained on the western parcel, the drive will <br />cross both parcels/properties, which are currently co-developed. The western property is <br />split zoned, with General Retail Business zoning the first 500 feet and Single Residence <br />zoning thereafter to the northern property line. The tower location abuts commercial <br />property to the east, the Welcome House group home development to the west, and the <br />Cleveland Metroparks to the north. Cell towers are permitted as a conditional use in the <br />WTFO subject to the requirements of 1151.04(b), and so long as the base zoning is <br />General Retail Business, Industrial or Mixed Use. Therefore, the residential portion of <br />the property must be rezoned to General Retail Business. Furthermore, this property <br />must be added to the city's Wireless Telecommunications Facilities Overlay District <br />(WTFO). Two pieces of companion legislation will accomplish the rezoning and <br />inclusion in the overlay district, Ordinances 2008-36 and 2008-37. Rezoning will <br />accomplish one of the recommendations of the 2005 Master Plan, which is to eliminate <br />split zoning of parcels where feasible. The tower is a 170 feet tall monopole, extendable <br />to 190 feet. The grade of the site is lower to the rear, losing 20 feet +/- from Lorain Road <br />to the location of the tower. The compound will be surrounded by a 6 foot high boazd- <br />on-board fence and a landscape buffer 15 feet wide consisting of evergreen trees planted <br />7-8 feet in height. Additionally, two landscape beds with a variety of plant materials are <br />proposed to be installed near Lorain Road to enhance the streetscape. One variance was <br />obtained from the BZA, which was a variance for proximity to a residential district. It <br />was determined that the residential district was the Metropazks and baeklands of split <br />zoned commercial properties which would not feasibly be developed for residential use. <br />6 <br /> <br />
