4,w <br />Council Minutes of 4/15/2008 <br />Councilman Barker said he would echo what Mr. Dubelko said. As chairman of BZD <br />and someone who believes in property maintenance, if there are some things in the <br />legislation that seem to go above and beyond what they should, it will be addressed. <br />Councilman Ryan said previously he represented the Building Dept. for 25 years, and the <br />court system was never used to enter property. So, there is a whole history on it. We just <br />don't do it. <br />Mayor O'Grady said, if there is a problem with this or any other program that's being run <br />in his administration, he will take immediate corrective action. <br />Sharon Senal, 5187 Columbia Road, is concerned because the legislation does not say <br />that warnings are given first. Section 1351.01 speaks about citations and says nothing <br />about getting a warning first. Secondly, if a person is on vacation for a week and a <br />violation is put on the front door and they don't know about it until they get back from <br />vacation, they could akeady be into a category of a $150 fine and possible jail time. <br />Third, she has a large family and she lives on Columbia Road where parking is limited. <br />If they have a family gathering, they want to put their family's cars on the front lawn. If <br />that is not permissible, where can they park? <br />Councilman Barker answered that, in the case of a vacation, a phone call to the Building <br />Dept. when you return will solve the problem. It's a kinder, gentler atmosphere. It's <br />always been the practice that the inspectors talk to residents to find out if there is a <br />problem and then deal with it. Parking cars on a lawn for a party is not a problem. The <br />code is for cars that are left on the front lawn for so long that grass can be growing <br />around and under it. It's a common sense issue. The inspectors are open to any kind of <br />problem and situation. If you do get a violation for something that you just can't take <br />care of in a week, they're going to work with you. They can allow you up to sixty days <br />to fix a problem. It's just communication. <br />Safety Director Thomas commented the purpose of the legislation is to lay out penalties, <br />which is required by law. A warning tag is a policy and, therefore, not dictated to have a <br />penalty. Warning tags are not included in the legislation because it's the policy not <br />penalty. By administrative internal policy, warning tags will always be issued. We will <br />always ask a resident to comply first. Then, when we get resistance, use the force of law <br />to enforce the code. <br />LEGISLATIQN <br />Resolution No. 2008-23 introduced by Mayor O'Grady was given its third reading. A <br />resolution endorsing fair employment practices in Northern Ireland, known as The <br />MacBride Principles, and urging adoption thereof by the State of Ohio in appropriate <br />State statutes, as amended. Councilman Gareau moved for adoption, and the motion was <br />seconded by Councilman Kearney. Roll call: Gareau, yes; Kearney, yes; Orlowski, yes; <br />Ryan, no; Jones, yes; Barker, yes; Mahoney, yes. The motion passed with six yes votes <br />and one no vote.
