<br />Council Minutes of 4/1/2008 <br />supplemental authority in that action. A supplemental authority is Judge Sutula's <br />judgment. We will be participating in that case also. <br />• Szarka v. City of North Olmsted, which is pending in the Cuyahoga County Court of <br />Appeals. The city prevailed at the Common Pleas Court level in that case. A conference <br />hearing has been scheduled for April 16. The purpose of the conference hearing is for the <br />parties to talk and see whether or not it can be resolved without going forward and briefs <br />being filed, arguments being made, and the court ruling on the merits. <br />• Hearing date on an arbitration involving a fire fighter grievance relating to the subject of <br />use of comp time is set for 3une 10 before arbitrator Harry Graham. <br />• Laser Wash case is scheduled for trial on April 17. A proposed new minor change has <br />been submitted. If that is approved by the city, it will probably result in a plea being <br />taken and the case being resolved. <br />• City of North Olmsted v. Suburban Collision Center, the nuisance odor citation that is <br />pending in Rocky River Court. A motion to dismiss has been filed. New counsel has <br />entered an appearance in the case. The new attorney's name is Richard Panza from the <br />law firm of Wickens & Panza. He has filed a motion to dismiss, and the city will be <br />obviously opposing that motion at the appropriate time. <br />3) Prosecutor's report: Traffic and General Offenses prosecutions were down in March with a <br />total of 210 cases. Ninety-seven were General Offenses cases, the remainder were traffic, and <br />there were no trials. <br />4) Carole Heyward has reported that HUD has completed its audit of the city's fair housing <br />program for this year and that she believes the audit went well. There are no apparent problems <br />with the city's capacity building program. <br />Finance Director Copfer: 1) On March 19, the Finance, Building and Engineering divisions met <br />to coordinate the workload of engineering paperwork and documentation of the deposits and <br />permits they manage to ensure we are maintaining the records we require as we consolidate. It <br />was a good healthy discussion and more exploration is required before we have another meeting <br />to resolve the final issues. <br />2) Last week, Nat City Investments sold the $2,370,000 in bond anticipation notes which shall <br />mature on April 2, 2009. The interest rate is 2.35% which will be $55,695 in interest costs that <br />will be due in 2009. The broker fees and other costs of issuance, such as OMAC, Cusip <br />numbers, etc totaled $4,621.50 and were paid for through the issuance rate. The bond counsel <br />fee is $7,000 and will be paid out of the applicable funds, not within the issuance proceeds. <br />3) The Police union employees received their raises March 21 and their retro-pay for 2007 and <br />2008 is in this Friday, April 4, pay. We are still awaiting the fire union officials to sign the final <br />labor contract. <br />Councilman Gareau made a motion to amend the agenda to include on first reading Resolutions <br />2008-50 and 2008-51. The motion was seconded by Councilman Barker and passed <br />unanimously. <br />Councilman Ryan, chairperson of the Intra-Governmental Relations Committee: 1) Councilman <br />Ryan made a motion to amend Resolution Nos. 2008-23, 2008-41 and 2008-42, which have been <br />previously posted by the Clerk of Council pursuant to rule and also were distributed to all <br />members of Council. The amendment to Resolution 2008-23 consists of a change in the <br />heading, and the amendments to Resolutions 2008-41 and 2008-42 are to the distribution of the <br />legislation.
