<br />Council Minutes of 4/1/2008 <br />2) At the committee meeting of March 12, 2008, all members were present and the legislation <br />was discussed: <br />• Resolution 2008-23, as amended. A motion was made by Mr. Orlowski and seconded by <br />Mr. Gareau that this resolution be recommended to Council for passage. The vote was 2- <br />1 with Mr. Ryan dissenting. <br />• Resolution 2008-41, amended version. A motion was made by Mr. Ryan and seconded <br />by Mr. Orlowski to recommend to Council passage. The vote was 2-1 with Mr. Ryan <br />dissenting. <br />• Resolution 2008-42. Motion was made by Mr. Orlowski, seconded by Mr. Gareau, <br />recommending passage of Resolution No. 2008-42. The vote was unanimous 3-0. <br />Councilman Barker, chairperson of the Building, Zoning & Development Committee: 1) The <br />Building, Zoning and Development Committee met Tuesday, March 24, 2008 at 7 p.m. Present <br />were committee members Barker, Gareau and Dailey Jones; Councilman Orlowski; Planning <br />Director Wenger, Assistant Law Director O'Malley. The committee discussed the Clark Gas <br />Station located at 28915 Lorain Road near Stearns Road. The proposal consists of an addition to <br />the existing gas station structures, an additional gas pump and site improvements. The existing <br />lot and site layout poses significant development challenges. The lot is less than one third of an <br />acre and falls well short of minimum lot size requirements. Additionally, the existing building is <br />non-conforming, as it violates the rear setback. As a result, special permits from BZA and <br />variances from Chapter 1165 were granted. Many other variances were granted for front and <br />rear setbacks, side yard setbacks, lot coverage, not enough parking, excessive lighting and lot <br />size. The existing structure is approximately 400 square feet, and the proposed addition would <br />increase the building size to approximately 1,200 square feet. This addition would accommodate <br />more convenience sales and consolidate some of the vending machines and merchandise that are <br />currently outside the building. The building addition will be brick and glass with a band of metal <br />siding around the top of the structure. In addition to the building, two brick enclosures are <br />proposed, one to contain the dumpster on the east side of the building and one to contain propane <br />and ice sales on the west side of the building. An air pump will be installed adjacent to the new <br />gas pump. There will be new asphalt and concrete work, new gas pumps, parking spaces, <br />landscaping, new lighting, and the refurbishing of the canopy. Basically, this is a total <br />rehabilitation of the property without having to close down. There were many questions by <br />committee members; and Mr. Mongello and Mr. Manning, representing Clark Gas Station, along <br />with Ms. Wenger, answered all questions to the committee's satisfaction. Mr. Gareau brought up <br />our new temporary sign ordinance and the sidewalk sale issue to remind Clark that those are <br />some things that we would like not to see. It was noted that this is the reason the owners of <br />Clark were doing the renovation-to help clean up the area. Also, Ms. Jones brought up the <br />canopy sign that is being installed in place of a monument sign. Traffic patterns, flow of traffic, <br />and delivery times were also discussed. Ms. Jones stated that this improvement was a welcome <br />sight to this area and of this property. It was also noted that the committee would see more <br />development improvement with other parcels in the area because of the Stearns Road project. <br />Ms. Jones made a motion to approve the Clark Gas Station proposal located at 28915 Lorain <br />Road with all changes and variances approved by Planning and Design and the BZA. The <br />motion seconded by Mr. Gareau and the committee vote was 3-0 for approval. With no other <br />business before BZD, the meeting was adjourned at 7:30 p.m. <br />Councilman Barker moved to approve the proposal for Clark Gas Station at 28915 Lorain Road, <br />consisting of a new addition and site improvements, as shown on the plans stamped as received <br />4 <br /> <br />
