Council Minutes of 3/5/2008 <br />Councilman Gareau made a motion to table the following legislation: 2005-11, 2005-60, <br />2006-128, 2006-161, 2007-95 and 2007-1.13. The motion was seconded by Councilman <br />Barker. Roll call: Gareau, yes; Barker, yes; Mahoney, yes; Ryan, yes, with comment <br />that 2007-95 is not something he wants to let go. He will either reintroduce the issue or <br />go after it a different way. Roll call continued: Orlowski, yes; Kearney, yes; Jones, yes. <br />The motion passed unanimously. Ordinance Nos. 2005-11, 2005-60, 2006-128, <br />2006-161, 2007-95 and Resolution No. 2007-113 tabled. The titles of the tabled <br />legislation are as follows: <br />• Ordinance No. 2005-11 introduced by Councilman Gareau. An ordinance <br />amending Sections 1363.08 and 1363.10 of Chapter 1363 of the Real Property <br />Maintenance Code, by removing the administrative appeal and variance <br />procedures contained therein, and otherwise streamlining the violation and notice <br />procedures contained therein, in order to provide for more effective Real Property <br />Maintenance Code enforcement in the city of North Olmsted, and declaring an <br />emergency. <br />• Ordinance No. 2005-60 introduced by Council Members Kasler, Gareau and <br />Miller. An ordinance creating new Chapter 906 of the Streets, Utilities and Public <br />Services Code, entitled "Newsrack Regulations," in order to set standards and <br />regulate the location of newsracks in the public right-of--way and elsewhere within <br />the City of North Olmsted. <br />• Ordinance No. 2006-128 introduced by Councilman Gareau. An ordinance <br />creating new Section 763.02 of Chapter 763 (Retail Business Regulations) of the <br />Business Regulation Code in order to reduce or eliminate nuisance odors <br />emanating from paint spraying operations conducted near residential <br />neighborhoods, and declaring an emergency, as amended. <br />• Ordinance No. 2006-161 introduced by Councilman Orlowski. An ordinance <br />creating new Section 763.03 of Chapter 763 (Retail Business Regulations) of the <br />Business Regulation Code in order to regulate the storage of snowlice removal <br />equipment on Commercial, Business Retail, Mixed Use and Multi-Family <br />properties. <br />• Ordinance No. 2007-95 introduced by Councilman Ryan. An ordinance <br />amending Section 525.16 of the General Offenses Code so as to <br />provide criminal penalties for stores that allow shopping carts to be removed <br />from their facility or property. <br />• Resolution No. 2007-113 introduced by Councilman Orlowski on behalf of <br />himself, the entire City Council and the Mayor. A resolution urging the <br />Cuyahoga County Engineer to name the new section of County Road 76 from <br />Lorain Road north to the North Olmsted corporate line Stearns Road. <br />Resolution No. 2008-35 introduced by Mayor O'Grady was given its second reading. <br />A resolution authorizing the Mayor to accept a donation of skate board half pipe ramps <br />consisting of four (4) quarter pipes on each side from Ted Vovos for use at the North <br />Olmsted Skate Park only. Councilman Mahoney moved for suspension of the rule <br />requiring three readings noting it had been heard in committee and for reasons he <br />8 <br />
