Council Minutes of 2/19/2008 <br />Don DeBrodt, 23141 Stoneybrook Drive. Mr. DeBrodt noted, although there is a five <br />minute rule on speakers addressing Council, apparently there is no restriction on the <br />length of letters that are read and then are supplemented with another five minutes. Is <br />that the way the Council operates? President Kennedy noted that Council does have the <br />ability to make a lengthy communication part of the record. Councilman Barker said <br />Council can vote to give a speaker more time. <br />LEGISLATION <br />Councilman Gareau made a motion to amend the agenda to remove from first reading <br />Resolution 2008-33. The motion was seconded by Councilman Barker and passed <br />unanimously. Resolution No. 2008-33 was removed from the agenda. <br />Ordinance No. 2007-156 introduced by Mayor O'Grady was given its third reading. An <br />ordinance amending the organizational charts of the Engineering and Building Divisions <br />of the city in order to deliver services from each division in a more efficient and <br />economical manner as amended. Councilman Gareau moved for adoption, and the <br />motion was seconded by Councilman Barker. Roll call: Gareau, yes; Barker, yes; Jones, <br />yes; Kearney, no; Mahoney, yes; Orlowski, no; Ryan, no. The motion passed with four <br />yes votes and three no votes. Ordinance No. 2007-156 adopted. <br />Resolution No. 2008-3 introduced by Councilman Gareau was given its third reading. A <br />resolution urging the Cuyahoga County Engineer and the Director of the Ohio <br />Department of Transportation ("ODOT") to inspect Lorain Road (SR-10) from <br />Canterbury Road to the City's east corporation line in order to determine whether the <br />2006 resurfacing of Lorain Road, which is badly cracking, by a State of Ohio contractor <br />was performed in accordance with ODOT bid specifications and all other ODOT <br />roadway and other requirements and standards, and declaring an emergency. <br />Councilman Gareau moved for adoption, and the motion was seconded by Council <br />Member Dailey Jones. Roll call: Gareau, yes, with comment. The city has been poorly <br />served by this project. He drives Lorain Road every day from one end of town to the <br />other, and every time he drives over this section of road it infuriates him. We spent six <br />figures on this project. The State of Ohio, through the County, spent an additional sum of <br />money. There are now portions of the road where the cracks have joined that have now <br />formed a space in the middle, which to him is the beginning of a pothole. The road is <br />less than 18 months old. It will never last the 20 years that it was supposed to, short of us <br />being out there every year spending tens of thousands of dollars in maintenance. He is <br />voting for this because he thinks somebody has to step up and pay close attention beyond <br />the borders of the City of North Ohz~sted-whether it's the County or the State. It's got <br />to get fixed. He thinks back to when tl~e city was told that we didn't maintain the bridge <br />on Rt. 252; and, as a result of that, ODOT said North Olmsted had to pay to fix it. That <br />got taken care of, but he could see the same arguument being made here 10 years from <br />now when an intersection that is very heavily used by trucks, and it's a designated truck <br />route, is falling apart 18 months after we paid for it. He is waiting for the argument that <br />says North Olmsted should have to pay the bill to resurface the road because they didn't <br />maintain it and didn't spend $20,000 a year in crack seal because the road was poorly <br />8 <br />
