<br />Council Minutes of 2/5/2008 <br />i~~, <br />requesting proposals in connection with personal service contracts, and repealing <br />Sections 111.03 et seq. of Chapter 111 of the Administrative Code. Councilman Gareau <br />moved for adoption, and the motion was seconded by Councilman Barker. Roll call: <br />Gareau, yes, with comment that he votes yes for this because of the greater issue of <br />establishing a formalized process for personal services contracts. But he does have <br />reservations with respect to the provision that the bond counsel and financial advisors <br />consistent with borrowing are included as an exception. He would encourage, despite <br />that fact that the administration utilize its very own RFP process, to at least select and <br />make available for review any individual who may respond to the RFP so that we can <br />present to the Board of Control those people we believe are best qualified. It may be the <br />people we have now. But at least we are able to go through the process the way it's <br />intended to for every contractor-not to exclude one or two contractors. He believes the <br />contractors excluded are the golf pro, gymnastics teacher, and bond counsel. It's <br />inconsistent to have those types of exception in a law. He would encourage the <br />administration to follow that law even though it is not required to with those positions. In <br />spite of that, the greater good is served by the ordinance. He will vote yes. Roll call <br />continued: Barker, yes; Jones, yes; Kearney, yes; Mahoney, yes; Orlowski, yes; Ryan, <br />no. The motion passed with six yes votes and one no vote. Ordinance No. 2007-68 <br />adopted. <br />Ordinance No. 2007-72 introduced by Mayor O'Grady on behalf of himself and Council <br />Members Barker and Jones was given its third reading. An ordinance amending Sections <br />721.01, 721.03 and 721.09, and creating new Section 721.031 of Chapter 721 of the <br />Business Regulation Code (Peddlers, Solicitors and Canvassers) in order to create a "Do <br />Not Knock Registry" and to update various other provisions of this Chapter of the <br />Business Regulation Code, as amended. Councilman Barker moved for adoption, and the <br />motion was seconded by Council Member Dailey Jones. Roll call: Barker, yes; Jones, <br />yes, with comment. This legislation seems like it has been a long time coming that it has <br />been talked about and reworked She appreciates all the efforts of Mr. Barker and the <br />Law Director in crafting this and all of Council. She is pleased to bring this service to <br />our residents. Roll call continued: Mahoney, yes; Ryan, no, with comment. The First <br />Amendment of the United States is a very difficult amendment. It is difficult to give <br />people free speech. It's often uncomfortable. But as we continue down a path of making <br />it comfortable for people, we start biting against the First Amendment right we have for <br />free speech. He believes this is going too far and can't in good conscience vote yes on <br />this. Roll call continued: Gareau, yes; Kearney, yes; Orlowski, yes. The motion passed <br />with six yes votes and one no vote. Ordinance No. 2007-72 adopted. <br />Resolution No. 2007-151 introduced by Mayor O'Grady was given its third reading. A <br />resolution authorizing the Director of Public Service to advertise for bids for diesel fuel <br />and gasoline products for use by the City of North Olmsted, as per specifications now on <br />file in his office, and authorizing the Mayor to contract for same, and declaring an <br />emergency. Councilman Gareau moved for adoption. The motion was seconded by <br />Councilman Barker and passed unanimously. Resolution No. 2007-151 adopted. <br />9 <br />
