The <br />reason he put an emergency clause into 2007-157 was because that's continuity with <br />engineering services. We wouldn't have any services without it. In answer to a question <br />by Councilman Gareau, Law Director Dubelko said, if Ordinance 2007-157 is passed, it <br />presumes there is going to be a reorganization. What happens if there is no action taken <br />on 2007-156? They are so related that he would have to counsel the administration and <br />City Council to deal with them together. Also, there are additional steps. As he <br />previously advised, once you reorganize and you're proposing to abolish positions, notice <br />has to be given to Civil Service. Civil Service has to abolish positions. There are labor <br />issues involved where the unions have to be addressed. He has already counseled to give <br />notice to the unions this is coming and give notice to Civil Service that this <br />reorganization is coming. You really can't go forward and sit down and negotiate affects <br />with the union and go to Civil Service formally on the abolishment before Council has <br />actually reorganized. So, 2007-156 is critical, not just with 2007-157 but with <br />implementing the reorganization with Civil Service concerns and labor. <br />Councilman Mahoney continued the Recreation, Public Parks and Buildings Committee <br />report: The committee met on January 22, 2008 at 7 p.m. Present were committee <br />members Dailey Jones and Mahoney; Councilmen Barker, Orlowski, Gareau, and <br />Kearney; Community Life Services Director Dailey, and Recreation Commissioner <br />DiSalvo. On the agenda was Ordinance 2008-8, an ordinance authorizing the Mayor to <br />enter into a second renewed two-year agreement with Bob's Ice Cream Inc., DBA as <br />Quality Quick Snacks for providing services regarding vending and video game machines <br />at the North Olmsted Rec Center and declaring an emergency. Commissioner Di5alvo <br />and Community Life Services Director Dailey addressed concerns expressed by <br />Councilman Gareau and committee members Dailey Jones and Mahoney. After the <br />discussion and having the questions answered to Council's satisfaction, the committee <br />recommended by a vote of 2-0 to recommend passage of Ordinance 2008-8. The purpose <br />of the suspension and the emergency was that this was a continuation of services <br />authorized by Ordinances 2004-7 and 2005-150. After having the time to consult with <br />Commissioner DiSalvo and Director Dailey, Council Members were satisfied with the <br />services rendered by Bob's Ice Cream Inc. <br />LEGISLATION <br />Ordinance No. 2007-156 introduced by Mayor O'Grady was given its second reading. <br />An ordinance amending the organizational charts of the Engineering and Building <br />Divisions of the city in order to deliver services from each division in a more efficient <br />and economical manner. <br />Resolution No. 2007-157 introduced by Mayor O'Grady was given its second reading. A <br />resolution extending and amending the city's consulting engineering contract with <br />Richard L. Bowen & Associates, Inc., which, inter alia, provides for the renewal of the <br />appointment of Daniel J. Collins to be City Engineer and for the appointment of Pietro A. <br />DiFranco to be Assistant City Engineer, and declaring an emergency, as amended. <br />7 <br />
