Council Minutes of 9-15-2009
2) Resolution 2009-103 was on the agenda. That is a resolution introduced by
Councilman Mahoney canceling the current agreement and authorizing the Mayor to
enter into a new agreement with the North Olmsted School District granting the school
district the license to install and maintain a removable fence on Diamond Number One
Baseball Field at North Olmsted Park. Present were Councilmen and committee
members Brossard, Jones, and Mahoney; Councilmen Kearney, Gareau, Orlowski, and
Barker; Community Life Services Director Dailey; Ted DiSalvo, Recreation
Commissioner; the. high school coach Tim Murphy; and representatives from Hot Stove
Baseball League included Mr. Bob Finch and Mr. Ron Tallon, Jr. Also present were
representatives from the Scouts, mainly the organizational directors from the All-Scout
Weekend. They heard from a variety of different individuals as mentioned, each
presenting their own different viewpoint in regards to the fence at North Olmsted park.
As a result of the meeting and discussion that was had, it was agreed by the committee by
a vote of 3-0 to amend Resolution 2009-103. First amendment was the fence would be
removed no later than July 31St each year, and school representatives would be the agency
to take down the fence and put the fence up as needed. Secondly, that would be done in
order to accommodate the participants in the annual All-Scouts Weekend and NOSO
Cup. Councilman Mahoney asked Mr. Dubelko if he has to amend the license in addition
to the legislation. Mr. Dubelko responded that the agreement is part of the legislation, so
the motion to amend the legislation specifying what is being amended will be sufficient.
Councilman Mahoney made a motion pursuant to the Law Director's recommendation
that the amendment to 2009-103 and the irrevocable license agreements attached as
Exhibit A be amended consistent with the committee changes. Motion was seconded by
Councilwoman Dailey Jones and passed unanimously. Resolution 2009-13 amended.
Councilman Mahoney reminded everyone that this Saturday, September 19t" at 6:30 p.m.,
the North Olmsted Police Department will be playing the North Ridgeville Police
Department in an annual charity game of flag football.
